Item/Subject: Authorizing Poe Discontinuance of Emerson Street

Commentary:
The City has recently received a request to discontinue Emerson Street. Attached
is a ropy of a memorandum to the Municipal Operations Committee from Me City
Engineer, which summarizes the issues associated with this request.
The attached Council Order is &a first step in the process of discontinuing
Emerson Street.
The City Engineer will subsequently ratify abutting property owners of the
contemplated action, schedule a public hearing, and submit a written report to the
City Council for final action.

WHEREAS, ovmers of properties adjacent to Emerson Sheet have requested its
discontinuance, and;
WHEREAS, Emerson Street is no longer considered necessary to serve the public needs
NOW, THEREFORE BE IT ORDERED, that the City Engineer be and is lum by
autho med end directed to begin the process of discontinuing Emerson Street in
accordance with the provisions of 23 MRSA. § 3026 end submit a written report to the
City Council for mother action. -

Recently I received a request from Ray Cote to discontinue Emerson Sheet. W. Cotes
represents the interest of Webber Oil and the Holiday hen properties on lower Main
Street, listed as owned by Kenduskeag Yacht Club.
Emerson So= is a 60 -foot wide dead-end street accepted in 1869, which extends
southeasterly 670 feat from Mater Street. It =a between the two Holiday Inn structures
anal property interests represented by Mr.Cora. -
In 1973, the City executed a 60 year lease penning air rights In the Holiday Inn owner for
thepurpomofc urn otmgandmmntainingovuheadc pies,walkways,etc. Thchass
provides for $150 amoral payments to the City, which have been paid. A copy of the
lease is attached.
If Emerson Street is discontinued, ownership of the street right-of-way would revert to
the abutting properties. Attached is a memmandum from Ben Birch, which indicates the
change in property values, which would occur if Emerson Strad is discontinued. The
increased property values would genera¢ $2,708.91 in additional tax revenue. Our
annual maintenance dots for Emerson Street are approximately $1;100.00.
I see no public need for retaining Emerson Street as a public way, and recommend that
the appropriate steps be taken 0 discontinue it. Upon discontinuance a 'Public
Easement" would be retained for maintaining necessary public utilities.
