As the Coumil is aware, the Qty has made application to acquire the Slager Budding on Union Snit for use
by the Scholl Department. For edutatlorel purposes, the property, may be transfened to us at no cost As
part of the process of acoulslton, the UMe l Rates Department of Edumtcar requires the City to pass a
resolution in a specified farm. The attached Resolve mass this requirencM.
I have been Informed that Me City is 8:e only parry under tensional far the transfer of this property. It
also appears that we are In a good position to obtain the elucodunal discount benefit untler which we will not
have M pay for the property.
As you are also aware, this property has been vacant and unused for a co:uldemble ems. The Scholl
Department is currently In the process M having the building evaluated and developing cost esvmates far its
renovation and rehabllitatlon. The CWs eventual tlecisim on wheder or net to amVt this property will, of
course, be dependent upon Mese estimated casts.

RESOLVED,
WHEREAS, certain real property owned by the United States of
America, located in Bangor, County of Penobscot, State of Maine,
(and designated in City records as Assessor's Map R-24, Lot 5-A)
has been declared surplus to the needs of the Federal government
and is subject to assignment for disposal for educational purposes
by the Secretary of Education, under the provisions of Section
203(k)(1)(a) of the Federal Property and Administrative Services
Act of 1949 (63 Stat_ 377), as amended, and rules and regulations
promulgated pursuant thereto, more particularly described as
follows;

NHEREAS, the City of Bangor needs and cautilize said property for
educational purposes in accordance with the requirements of said
Act and the rules and regulations promulgated thereunder of which
this Council is fully informed, including commitments regarding use
and time within which such use shall commence.
NOW, THEREFORE, by the City Council of the City of Bangor, be it
RESOLVED,
THAT the City of Bangor shall make application to the Secretary of
Education for, and secure the transfer to it of, the above-
mentioned property for said use upon and subject to such
conditions
exceptions, reservations, terms, covenants, agreements,
and restrictions as the Secretary of Education, or his authorized
representative may require
in
connection with the disposal of said
property under said Act andrules and regulations issued thereto;
and
be it further,

RESOLVED,
THAT the City of Bangor has legal authority and iswilling and is

in a position financially and otherwise to a immediate care
and maintenance Of the property, and that Edward A. Barrett, City
Manager, is hereby authorized, for and on behalf of the City of
Bangor to do and perform any and all acts and things which may be
necessary to carry out the foregoing resolution including the
preparing, making and filing of plans, applications, reports and
other documents; the execution, acceptance, delivery and
recordation of agreements, deeds and other instruments pertaining
to the transfer of said property; and the payment of any and all
same necessary on account of the purchase price thereof including
fees o costs incurred i connection with the transfer of said
propertfor surveys,
rveys, title searches, real estate appraisals,
recordation of instruments or costs associated with escrow
arrangements; together with any payments necessary by virtue of
nonuse or deferral of use of the property. If the applicant is
unable to place the property into use (or determines that a
deferral of use should occur), IT IS UNDERSTOOD AND AGREED that the
City of Bangor will pay to the United States Department of
Education for each month of nonuse beginning twelve (12) months
after the date of the deed, or thirty-six (36) months where
construction or major renovation is contemplated, the a= of
1/360th of the then current fair market value of the property for
each month of nonuse. If submission of the Application For Public
Benefit Allowance Acquisition Of Surplus Federal Real Property For
Educational Purposes is approved, a copy of the application and
standard deed conditions will be filed with the permanent minutes
of the City Council.

A certain parcel of land with the improvements thereon
situated in the City of Bangor, County of Penobscot, State of
Maine, being more particularly bounded and described as
follows:
Beginning at a bolt set on the northeasterly side of Union
Street at land of Lipman Brothers, Inc., said point being the
southwesterly comer of land formerly of Stanley M. Murray and
Helen R. Murray; thence southeasterly by Union Street 350.00
feet to a point; thence turning an interior angle of 750 061
and running northeasterly 633.5 feet, more r less, to a point
at land of Thurman Jenkins; thence turning an interior angle
of 1051 271 and running northwesterly by land of Thurman
Jenkins 152.5 feet, more or leas, to a bolt; thence turning an
interior angle of 1781 59' and running northwesterly by land
of Thurman Jenkins 197.55 feet, more or less, to a bolt set at
land of Lipman Brothers, xnc.: thence turning an interior
angle of 751 34' and running southwesterly by land of Lipman
Bros., Inc. 633.50 feet to the point of beginning.
