Item/Subject Amendment to Code of City of Bangor, Section 28-31,
to Clarify Authority of Fire Department to do Inter -Facility
Transfers

Currently, the Bangor Fire Department provides ambulance service
for inter -facility transfers both within and without the City
limits. In addition, the Fire Department provides ambulance
service, upon request, to communities with which Bangor have a
mutual aid agreement. The city's current ordinance regarding the
powers and duties of the Bangor Fire Department dont specifically
provide for such activity, and is arguably ambiguous on this
point. This Ordinance amendmentwill clarify this matter and
provide for the Fire Department to continue its current ambulance
services.

[WHEREAS, the City of Bangor Fire Department currently does
inter -facility transfers, both inside and outside of the city
limits of the City of Bangor; and
WHEREAS, the current ordinance pertaining to emergency
medical services does not clearly state that inter -facility
transfers are
included in the powers and duties of the Bangor Fire
t
Deparment; and
WHEREAS, it bas and continues to be the intention of the
City Council of the City of Bangor that the powers and duties of
the Bangor Fire Department include inter -facility transfers, both
inside and outside the city limits of the City of Bangor,
NOW, THEREFORE, be it ordained by the City Council of the
City of Bangor that the Code of the City of Bangor is amended as
follows:
By adding the following:
Section 28-32 Powers aM Duties
G. Ambulance Services. To provide, in addition to
emergency medical services, described in section 28-32F above,
ambulance services forinter-facility -transfers. Said inter-
facility transfers may be within or without the city limits of the
City of Bangor. These services may be further defined from time to
time by policies adopted by Council Order.
And further, by adding the following to Section 28-32F:
Said emergency medical seincludes providing ambulance
services to municipalities that haveemutual aid agreements with the
City of Bangor, when requested by said municipality.

WHEREAS, the current ordinance pertaining to emergency
medical services does not clearly state that inter -facility
transfers are included in the powers and duties of the Bangor Fire
Department; and
WHEREAS, it has and continues to be the intention of the
City Council of the City of Bangor that the powers and duties of
the Bangor Fire Department include inter -facility transfers, both
inside and outside the city limits of the City of Bangor,
NOW, THEREFORE, be it ordained by the City Council of the
City of Bangor that the Code of the City of Bangor is amended as
follows:
By adding the following:
Section 28-32 Powers and Duties
G. Ambulance Services. To provide, in addition to
emergency medical services, described in section 2832F above,
Ambulance services for inter -facility transfers. Said inter-
facility transfers may be within or without the city limits of the
City of Bangor.
And further, by adding the following to Section 28-32F:
Said emergency medical service includes providing ambulance
services tomunicipalities that have mutual aid agreements with the
City of Bangor, when requested by said municipality.
