The proposed widening will allow greater roadway width and provide ma opportunity to create additional parking. Council Order 99-91 passed February 22, 1999 directed the City Engineer to take necessary actions required by State Statutes and report back to the City Council for final action. The Planning Board hes also reviewed the proposed widening and recommends approval. Passage of the attached Council Order would accept the City Engineer's Report and recommendation for widening Bayous Court and is the final step in this process. RIN, P.E FM eO].BK.W9 Cly E,gnnNDlredor of Public Berv¢m CITY ENGINEER'S REPORT May 5, 1999 CITY OF BANGOR TO THE CITY COUNCIL: Haynes Court is a public way which was accepted on September 10, 1956 which consists of a 20 foot wide rigboof-way extending from Harlow Street to Lower Abbott Square parking lot Become of limited right-of-way the thrvelet way is extremely narrow. Until recently, there has been no practical way to widen the existing roadway. Upper Abbott Square puking lot, which abuts Haynes Court on the southerly side is a[ a much higher elevation, sepammd by a retaining wall. The abutting property on the northerly side of Haynes Court has historically been Franey awned, and most recently occupied by the `Better Homes" building which was situated in close proximity In the Haynes; Court right-of-way. Several months ago the City of Bangor acquired the Better Homes property and demolished the building, thereby cresting room for widening the Haytms Color right-of-way. Council Order 99-91, passed February 22, 1999 directed the City Engincer to provide required public notice in accordance with 23 M.RS.A. § 3022 of the intention to widen Haynes Court along the northerly right-of-way line for the purpose of widening the existing Gaveled way and creating additional parking, end to submit a written report to the City Council for final action. Pursuant to Counted Order 99-91, the City Engineer has provided public notice. consistent with 23 URS.A. § 3022 as follows: Public Notices of proposed Haynes Court widening: • PostedonbulleGnboardat City M. • Posted on light pole on Harlow Stere[ mar entrance to Haynes Corot. • Posted on Mourning wall on southerly aide of Haynes Court. 99-175 Copies of the Public Notice were also provided to the Planning Board and utility companies with facilities located within Haynes Court. Although the City of Bangor owns all of the property involved in the proposed widening, a copy of the Notice was also provided to Presort Express, which is the only privately owned property abutting the proposed widening. In accordance with the above notifications, the City Engineer held a Public hearing on Tuesday, April 27,1999 to outline the proposed widening, which includes the area described as follows: A certain lot or parcel of land situated in the City of Bangor, County of Penobscot; State of Maine, bounded and described as follows: Beginning at the intersection of the noMweaterly line of Haynes Corot and the southwesterly live of Harlow Strep, thence northwesterly on and by said line of Harlow Street forty seven and five tenths (47.5) feet to a point, thence southwesterly two hundred twenty-nine and seventeen hundredths (229.17) feet in the northeasterly line of Lower Abbott Square parking lot, thence southeasterly by and along said parking lot line forty-six and twelve hundredths (46.12) feet b the northwesterly line of Haynes Court, thence northeasterly by and along said has of Haynes Court two hundred twenty-nine and eighty-three hundredths (229.83) feet to the point of beginning. Meaning and intending to include all of the land described in deed of George L. Tsoulas m the oily of Bangor recorded in the Penobscot Registry of Deeds Volume 6880, Page 132. No one appeared at the Public Hearing to speak relative to the proposed widening. The City Engineer was contacted on April 28, 1999 by Mr. Edward Armstrong, owner of Presort Express (adjacent property) who expressed support for the proposed widening. Gn Tuesday May 4, 1999, the City of Bangor Planning Board reviewed the proposed widening of Haynes Corot and voted to recommend that the proposed widening be approved by the City Council. The City Engineer recommends that the Haynes Court Right -of -Way be widened to include the area described above as pan of the accepted public way. Since the widening will serve the public need and interest with na detrimental impact to adjoining property, it is furter recommended thin no damages be paid as a result of the widening. E.D.T. in the third floor conference room, City Hall, 73 Harlow Sireet, lievgor, Maine or review the proposed widening of said portion of said street and apportion such damages or benefits soy person will sustain by reason thereof and apportion such damages or benefits, if my, according to law, upon the lots or protests of land damaged or benefited by such widening. I will be holding a public hearing relative to this matter in the third conference room rot City Han, 73 Harlow grant, on Tuesday, 27,1999 at 3:00 P.M. E.D.T. Enclosed is a copy of a recent Council Order directing the City Engineer to begin the necessary actions to accomplish the proposed discontinuance and a copy fm the formal public aorice. The public homing is the first step in the discontinuance gotten. At the hearing I will outline the proposal in further detail and explain the additional steps in the process for widening a public way. 1 would encourage you to attend next the public hearing if at all possible, as it provides an opportunity for you to offer continent and input relative to the proposed action.
