ORDERED, THAT WHEREAS, the General Electnc Company (GE), a corporation organized under the laws of the State of New York and operating in Bangor, Maine through its Industrial 8 Power Systems Business leases from the City of Bangor Building 4966 antl Building #468; and WHEREAS, GE and the Department of Environmental Protection (DEP), an agency of the State of Maine acting pursuant to 38 M. R.S.A. Section 1364, have entered into two (2) Administrative Orders of Consent (AOC) regarding the remediation of groundwater at Building #466 (GE Building 10) and Building #488 (GE Building 30); and WHEREAS, an objective of theAOC's is to implement a set of "property use restrictions" to minimize exposure of Me public health and the environment to the contaminants which may persist at the Site following the specified remediation; and WHEREAS, as a condition of the ADC's, Me DEP requires hat GE draft and present to the DEP and the City of Bangor for their review and approval, a set of "property use restrictions" to be recorded in the Penobscot County Registry of Deeds, to be followed by GE and its successors and assigns, and to ensure that the prospective assigns, purchasers, lessors, option holders, architects, general contractors and others are made aware of he restrictions in force at the Site; NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, THAT the City Manager is hereby authorized, on behalf of the City of Bangor, to record in the Penobscot County Registry of Deeds documents containing property use restrictions in a form approved by the City Solicitor or Assistant City Solicitor.
