Responsible Department: Airport Commentary: This Order authorizes the adoption of an Airport Public Use Policy. The purpose of this policy is to outline the circumstances under which groups or organizations may use Bangor International Airport (BGR) as a non-public forum. The purpose of the policy is to ensure that the terminals remain easily accessible to those who have airport -related business and those using the facility as a non-public forum. The policy will be in final form as approved by City Legal. This was reviewed and approved by the Airport Committee at its meeting on June 13, 2017. WHEREAS, the City of Bangor is the owner of the passenger terminals at Bangor International Airport; and WHEREAS, The purpose of this policy is to outline the circumstances under which groups or organizations may use Bangor International Airport (BGR); and WHEREAS, it is the intent of this policy to specifically limit the use of the Airport as a nonpublic forum in order to insure that the terminals remain easily accessible to those who have legitimate airport -related business without unsolicited interruption for non -airport related purposes. NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, THAT the attached Airport Public Use policy be Adopted by the Bangor City Council by Council Order. IN CITY COUNCIL JUNE 26, 2017 CO 17-232 PASSED s CITY CLE Z AIRPORT PUBLIC USE POLICY 1.0 PURPOSE 17-232 JUNE 26, 2017 Policy No.: P. The purpose of this policy is to outline the circumstances under which groups or organizations may use Bangor International Airport (the "Airport'). Further, it is the intent of this policy to specify allowed uses of the Airport as a nonpublic forum while ensuring that the terminals remain easily accessible to those who have airport -related business, without unsolicited interruption for non -airport related purposes. 2.0 POLICY It is the general policy that the Airport is intended for the use of those who have legitimate airport -related business, such as travelers and providers of support services. Other uses are generally prohibited, and those other uses that are allowed must accommodate those who have legitimate airport -related business. In addition, such uses must meet the following general guidelines: 2.1. Meeting and conference rooms are for Airport and other City business, and are not open to the general public. 2.2. Display areas are for Airport -approved advertising and other Airport purposes, and are not open to posting by the general public. All art displays and advertising materials must be approved by the Airport Director or his/her designee. In addition to these general principles, more specific guidelines can be found below which relate to particular areas and activities at the Airport. 3.0 EXPRESSION 3.1. First Amendment expressive activity is permitted only in the two areas designated by Airport management and located on the first floor in the domestic terminal (see attached diagram) except that activity that involves number of persons in excess of those permitted under this policy or that involve initiating contact with the traveling public. No activity shall include solicitation. 3.2. A permit must first be obtained by the Airport Director or his or her designee. Applications for said permits can be obtained at the Airport. 3.2.1. Permits shall be granted on a first-come, first-served basis. 3.2.2. Permits shall not be issued for a period greater than 30 days. An organization may not request a new permit until seven or fewer days remain before an organization's currently valid permit expires. 3.2.3. Each organization is limited to one permit at one time. In order to minimize any interference with travelers and support service a permit shall allow for 17-232 JUNE 26, 2017 no more than two people within the terminal at one time. 3.2.4. In the event that more than two organizations request permits for a particular time period, a redistribution of times and locations of permittees will be designated by the Airport Director or his or her designee to ensure that all individuals, groups, and organizations are treated equitably. This may include reducing the number of people allowed for a single organization to one. In order to minimize any interference with travelers and support services no more than four people total will be permitted at one time within the terminal. 3.2.5. As a condition for issuance of the Permit, the permittee shall indemnify and hold harmless the City from any and all claims, demands, suits, actions or proceedings of any kind or nature, including workers compensation claims, or by anyone in any way resulting from any act or omission of the permittee or such officers, agents or employees of the permittee. 3.2.6. The Airport Director or his or her designee may revoke a permit at any time upon failure of a party to abide by any provision of this Policy or of the Permit. 3.3. Each person must, at all times, conduct themselves in a I manner so as not to interfere with the operations of the Bangor International Airport, including, but not limited to, not interfering with the travelers and support services. 3.4. No person may use sound or voice amplification systems, musical instruments, radio communication systems, or other mechanical sound devices. 3.5. (Left blank) 3.6. No person may in any way obstruct, delay, or interfere with the free movement of any other person; seek to coerce or physically disturb any other person; or hamper or impede the conduct of any authorized business at the airport. Parties may not engage in solicitation. 3.7. No person may erect a booth, table, chair, or other structure. 3.8. No bags, containers, written materials, or other personal property shall be left unattended in any area of the airport. 3.9. Such activity shall be limited to business hours (8am-5pm, Monday through Sunday). 4.0 ART AREA 17-232 JUNE 26, 2017 The Airport shall have the authority to approve the displaying of art and art exhibits. Display of such art shall be governed by the following additional guidelines. 4.1. Approval to place such art must be obtained from the Airport Director or his/her designee. 4.2. The Airport may remove any art that has become outdated, due to space limitations, or when required to avoid visual clutter. Such removal is at the sole discretion of the responsible staff person and may be without notice to the organization that has placed the materials concerned. 4.3. The Airport has the authority to select the location of displays. 5.0 ADVERTISING 5.1. Advertising by outside organizations (i.e. those not affiliated with the City of Bangor) is not allowed except through the City's advertising concessionaire. 5.2. Advertising by outside organizations shall be allowed only in those areas designated by the Airport Director for such advertising. The areas are marked on the attached diagram. 5.3. All advertisements must clearly indicate the business or organization purchasing the advertisement. 5.4. Advertising areas may be marked with the term '"Advertisements" or other similar indications. 6.0 OTHER AREAS OF THE AIRPORT Other areas of the Airport are not open for use by outside individuals or organizations, except on legitimate airport -related business, and upon the approval of the Airport Director. The Airport, in the performance of its public functions, may host or sponsor meetings and events at the Airport by outside individuals or organizations. The Airport may also allow for peaceful demonstrations in the outside area designated, and located in front of the International terminal (see attached diagram). 7.0 RESPONSIBILITY FOR REVIEW The Airport Director shall periodically review this policy.
