In accordance with 30-A MRSA. § 3003, as the some may be amended from tlme to time, the International Building Code 2000, published by the International Cade Council, Inc., Is hereby adopted and incorporated by reference herein as the minimum standard for the construction, alteration, addition, repair, removal, demolition, use, location, acwpanty and maintenance of all buildings and structures and their service equlpmen5 both existing and proposed, located within the City of Bangor. § 81-2. Amendments Said Building Code Is adopted in its published form as if fully set forth herein, except as follows: A. Section 101.1 Is deleted and replaced with the following: 101.1 Title: These regulations shall be known as the "Building Code of the City of Bangor," hereinafter referred to as "this code." B. Section 103.1 and 103.2 are deleted and replaced with the following: 103.1 Code official: Further references in this code to the "code ofidaf' shall be interpreted to mean the Chief Code Enforcement Officer of the City of Bangor. C. Section 105.1 and 105.2 are deleted a r! replaced with the following: 105.1 By whom appllcation is made: Application for a'perant shall be made by the owner or lessee of the building or structure, or agent or either, or by the licensed engineer or architecct employed in connection with the proposed work. The full name and address of the owner or lessee, the applicant and of the responsible of kers, If the owner or lessee Is a corporate body, shall be stated in the appliadon. D. Section 108.2 is deleted and replaced with the following: 108.2 Fee schedule: Fees shall be paid to the City of Bangor In accordance with the schedule set forth In Chapter 109, Fees, Article I, Code Enforcement Permits, of the Code of the City of Bangor. 00-354 E. Section 113.4 is deleted and replaced with the fallowing: 113.4 Violation penalties: penalties for violations of this ode shall be imposed in accordance with 34A M.R.S.A. 4 4452, as the same may be amended from time to Time. Each day a violation shall be permitted to exist after notification by the Chief Cede Enforcement Officer shall constitute a separate offense. F. Section 114.3 is deleted and replaced with the following: 114.3 Unlawful continuance: Any person who shall continue any work in or about the structure after having been serves with a stop -work order, except such work as he or she is directed to perform to remove a violation or unsafe conditions, shall be guilty of a vlolation of this code. G. Section 115.1 Is call and replaced with the following: 115.1 Vacating structures: In addition W the enumerated circumstances in the International property Maintenance Code 2000, or subsequent amendments therero, the Code Enforcement Officer may order an immediate vacating of any par[ of, or all of, a structure who loses its source of heat, cooling, hot water, water supply or sewer service or has mairunctoning electrical service or has been substantially damaged due to fire or natural disaster. When, in the opinion of the code official, there Is actual and immediate danger of failure or collapse of a structure which would endanger life or when any structure has fallen and fife is endangered by the occupancy of the structure or when there is actual or potential danger to the building occupants or those in the proximity of any structure because of explosives, explosive fumes or vapors or the presence of toxic fumes, gases or materials or use of defective equipment, the code official is hereby authorized and empowered to order and require the occupants to vacete the premises forthwith. The code official shall cause to be posted at the main entrance to such structure a notice reading as follows: This stratum is unsafe and its use or occupancy has been prohibited by the code offcial." It shall be unlawful for any perms to enter such structure except for the purpose of securing the structure, making the required repairs, removing the hazardous condition or demolishing the strucwre. H. Section 112.2 is deleted and replaced with the following: 112.2 Application for appeal: The owner of a building or structure or any other person may appeal to the Boats of Appeals, as established by Chapter 23, Article 1 of the Code of the Cty of Bangor, from a decision of the code official refusing to grant a modificedor. to the provisions of this code covering the manner of construction or materials to be used in the erection, alteration or repair of a building or structure. Such appeal shall be commenced by following the procedures set form by Chapter 23, Article I of the Code of the Cry of Bangor. 1. The following sections are deleted in their entirety: 112.1 and 112.3. 1. Section 312.1 is deleted and replaced with the following: 312.1 General: Buildings and structures of an accessory character and miscellaneous structures not classified in any specific use group shall be coretucted, equipped and maintained to conform to the requirements of this cable commensurate with the fire and life hazard incidental to their occupancy. Use Group U shall induce fences, tanks, doling towers, retaining walls and buildings such as private garages, carports, sheds arts agricultural buildings. 00-394 K. Section 907.1 is deleted and replaced with the following: 907.1 General: No burglar and other emergency alarm described in Chapter 58, Alarm Systems, Article I, Burglar and Emergency Alarm Systems, of the Cade of the City of Bangor shall be Installed and operated In any structure unless the same shall be installed and operated in compliance with the National EleRdcal Code in effect in the City of Bangor at that time and unless the alarm user possesses or has been issued a valid permit pursuant to Chapter 58, Article I of the Cade of the City of Bangor.
