approach is take in recognitie that Me overwhelming majority of are and two family foram are
designed and constructed without the service of either an arNitect or an engineer. This mtle replaces
the (ABO One and Two Famlly Code which Me Oty has adopted, in the past by reference in the SOCA
Building Code. In this serles of adoptions, whicr comes after Me moodifcatkin of the Otys Ordinance
Book we are able to assign it a Clhapter number which we hope will hlghlght Me Code's W4 and
presence.

(TITLE.) Ordinance Amending he Code of the City of8 Enacting New Chapter 82 Building
Code- Residential.

In acoordance wim 30-A MRSA. § 3003, as the same may be amended from time to time, the
International Residential Code or One- and Two -Family I swellings 2000, published by the International
Code Coundl, Inc., is hereby adopted and incorporated by reference to regulate and control the
design, construction,quality of materials, erection, installation, alteration, repair, location, relocation,
replacement, addition m, use or maintenance of one, and two- family dwellings and townhouses
located in the Cry of Bangor.
§ 82-2. Amendments.
Said Building Code is adopted in its published form as if fully set forth hereln, except as follows
A. Section R101.I is deleted and replaced with the fallowing:
R101.1 Title: new regulations shall be known as the " Residential Building Code of the Cry of
Bangor," hereinafter referred to as 9his code."
B. Section R103.1 and R103.2 are deleted and replaced with the following:
R103.1 Cade official: Further references in Nis code to the °code official" well be interpreted to
mean the Chief Code Enforcement Officer of the City of Bangor.
C. Section R105.1 and R105.2 are deleted and replaced with the following:
R105.1 By whom application is made: Application for a permit shall be made by the owner or
lessee of the building or structure, or agent or either, or by the licensed engineer or architect
employed In mnnection with the proposed work. The full name and address of the owner or lessee,
the applicant and of the responsible officers, if the owner or lessee is a corporate hotly, shall be
stated In the application.
D. Section R108.2 is deleted and replaced with me following:
R108.2 Fee schedule: Fees shall be paid m me Cry of Bangor m accordance with the schedule set
font in Chapter 109, Fees, Article I, Code Enforcement Permits, of the Code "a City of Bangor.

E Section R113.4 is deleted and replaced with the following:
R113.4 Violation penalties: Penalties for vtoladons of this code shall be imposed in accordance
with 30-A M.R.S.A. 4 4452, as the same may be amended from time to time. Each day a violation
shall be permitted to exist after notification by the Chief Cade Enforcement officer shall constitute
a separate offense.
F. Section R114.3 is deleted and replaced with the following:
R114.3 Unlawful continuance: Any person who shall continue any work in or about the structure
after having been served with a stap-work order, except such work as he or she is directed to
perform to remove a violation or unsafe conditions, shall be gully, of a violation of this code.
G. The following sections are deleted in Meir entirely: 112.1 and 112.3.
H. Section 112.2 is deleted and replaced with the following:
112.2 Application far appeal: The owner of a building or structure or any other person may appeal
to the Board of Appeals, as established by Chapter 23, Article I of the Code of the City of Bangor,
from a decision of the code official refusing to grant a modification to the provisions of this code
covering the manner of construction or materials to be used in the erection, alteration or repair of a
building or structure. Such appeal shall be commenced by following the procedures set forth by
Chapter 23, Ardde I of the Code of the City of Bangor.
