Environmental Assessment of Penobscot River and Authorization to Pursue Legal Remedies

By Council Order 99-64 the City Council authorized the undertaking of an environmental
assessment of the Penobscot River and the required legal research into the source and potential
liability for the deposition of coal tar deposits in the River bed. The initial environmental
assessment and legal research has identified probable sources of coal tar deposits and other
environmental problems and sources of potential liability. Further environmental work and legal
action is required to determine the extent of the environmental problems and to pursue
potentially liable source(s).
This Order authorizes the City Manager to execute any documents required to complete
Me environmental work to assess the damage and clean-up alternatives and costs. It also
authorizes the City Manager and City Solicitor's Office to approve appropriate legal action to
recover costs from potentially liable source(s).

WHEREAS, the City Council by Council Order 99-84 authorized the undertaking of an
environmental assessment of the Penobscot River at and adjacent to the Bangor Harbor and
the required legal res°ard?into the source and potentialliability fbr-Me depontlon Nasal Sar,
deposits in the River bed.
WHEREAS, the initial errvldonmenual assessment and legal research has identifiled probable
sources of coal tar and environmeni problems and sources of potential liability
WHEREAS, fuller environmental we& all legal action is required to determine the extent of
the emnronmemal damage, dean-up altematNes all costs and to pursue the potentially liable
source(s).
NOW, THEREFORE, R is ORDERED that

mal tar deposits and other ewironmemal problems in the Penobscot River and adjacent areas.
It Is further ORDERED Mat the Oty Manager and ofike of the City Solicitor are authorized to
approve appropriate legal action to pursue the source(s) potentially liable for casts associated
with the clean-up of coal tar deposits and other ewironmental problems in the Penobscot River
all adjacent areas.
