organizational structure m allow staff to more effertively respond m cument werdoads and priorities. Key
elements of this dldcusdon included a desire to group similar Mi together, in particular Mose relatingto
economic and business development, and a recognibon that th City's primary economic development function
should be structured in such a way as to allow H m focus a greater proportion of its time ant attention an
such key Council prenties as business developnem, redghborhood Improvements, ant our waterfront.
The agarlcetl Ordinance amendment would implement a series of changes including:

Warks Division. While a minor charge, this recognizes that One current titles are not very descriptive and
seldom used.

Chapter 28 of the Code of the City of Bangor Is hereby amended as follows (additions are

§ 28-2. Administrative Services Director.
There is hereby authoneed and established the position of Administrative Services Director th be
appointed by the City Manager, subject to c nfirmabon by the City Council. The Administrative Services
Director shall appoint and supervise all employees in the Departmerd, subject to general supervision of
the Department by the City Manager and the director of the Office of Government Operations
§ 28-5. Airport Manager.
There is hereby authodzed and established the position of Airport Manager. The Airport Manager shall
superose the entire operation of the Airport Department This position shall be included In the
Personnel Clamfiratlon and Compensation Plan for the City of Bangor. The Airport Manager shall be
appointed by the Oty Manager on the basis of merit and fitness alone, subject to the confirmation by
the city Council.
A. Represent dry. The Airport Manager and/or the Ory Manager or the Director of the Office of
Business and Ecahornk Develoorn shall represent the city in all airport matters before the
Federal Aviation Administration (FAA), the Deparbnent of Transportation and such other agencies
as deemed necessary.
B. Monthly report to City Manager. The Alport Manager shall make a report to the City Manager
before the first Council meeting of each month as to the business of his or her Department during

C. Other dutiea The Airport Manager shall prepare plans, standards and directives as required by the
FAA or other federal agency for the operation of the airport and promulgate, subject to the
approval of the Airport Commitee, such plans, standarcis or directives in the form of rules and
regulations of the airport as provided in § 284B. in preparation of required security directives, the
Airport Manager and the Police Chief shall, for the safety of the traveling public, cooperate to
provide maximum protection against hijacidng, bomb explosions, bomb threats, civil disturberrce,
vandalism, property destruction or other violence. The Manager shall also perform such other
duties as may, lte prescribed by the City Manager, the Director of the Office of Business and

§ 28-15. Descent.
A. There a hereby authodeed and established the position of Bass Park Complex Director. This
position shall be included in the personnel Classification and Compensation Plan far the City of
Bangor. The Bass Park Complex Director shall be appointed by the City Manager on the bass of
merit and fibress alone, subject to confirmation by the City Council.
B. Duties. The Bass Park Complex Director shall serve as Department Director of the Bass Pada
Complex and shall manage the whole operation of the Department. The Directs shall make a
report to the City Manager before the first Council meeting of each month as to the business of his
or her office during ere Preceding month. He or she shall also perform such additional duties as
may be prescribed by the CM Manager, the Director of the Once of Bearer and Economic
Develoarl or by applicable state or local law.
§ 28-16. Establishment divisions.
There is hereby established a Department of Community and Economk Development for the City of
Bangor. This Department shall consist of the Economic DevekpneM, Community Development,
Manning and Code Enforcement Divisions.
A. Economic Development Division. The Economic Development Divismn Shall he responsible for the

B. Community Development Division. The Community Development Division shall he responsible for
the development of the city under the federal Community Development Block Grant Program and
other associated existing or future federal and state aid programs with a special emphasis on
neighborhood stabilization and improvement and providing greater opportunities to residents of
low and moderate Income.

§ 28-17. Community add Economic Development Director.
Thee is hereby established the position of Community and Economic DevelopmentDireclorto be
appointed by the City Manager, subject to confirmation by the qty Council. The Community and
Economic Development Director shall appoint and supervise all employees assigned to the Department,
subject to the general supervision of the City Manager and the Director of the Office of Business and
Economic Development,

§ 2&32. Powers and duties.
It shall be the function of this Department:
A. Fxtinghish fires. To provide for the extinguishment of fires, the saving of Iife and property from fire
and the performance of various miscellaneous services to the public of an emergency nature.
B. Inspections. To provide, in cooperation with the Cade Enforcement Division of the Community and
for the Inspection of potential fire hazard and order the
removal or remedy of any dangerous fire conditions in or near such building or structure, and such
order shall he complied with by the owner or occupant of such building or structure, and to inspect
any violations of the provisions of the laws of the state or any ordinance of the city affecting the
fire hazard.
§ 28-33. Fire Chief.
There is hereby authorized and established the pesiton of Fre Chief. This position shall be included in
the Personnel Classification and Compensator Man for the City of Bangor. The Rre Chief shall
supervise the entre operation of the Fre Department The Fre Chief shall be appointed by the City
Manager on the bass of merit anti fitness alone, subject to the confirmation of the City Cowen.
A. Rules and regulations. The Rim Chief shall provide rules and regulators for the government ant
effidenry of the Deportment and submit such rules and regulations to the City Manager, and sand
rules and regulations shall take effect when approved by the City Manager.
B. Fire Inspector. The Fire Chief or individual designated by the Chief shall be Fre Warden and Fire
Inspector and Is hereby authorized and required to perform all the duties of Fre Inspector under
and by virtue of the provisions of the revised statutes of Maine, as amended, and all acts additional
thereto and amendatory thereof.

order the cumemt shot off from such wires as he or she knwvrs or believes to be dangerous to IBe or

§ 28-46. Administrator.
Thee is hereby established the position of Adminktrator of the Bangor City Nursing Facilky. The
Admkirrshator of the Bangor City Nursing Facility shall supervise the entire operatrin of the Bangor City
Nursing Fadliry. This protein shall he Included In the Personnel Classification and Compensation Plan
forme City A Bangor. The Administrator shall be appointed by the City Manager on the basis of merit
and fitness alone subject to confirmation of Me City Control.
A. Admissions b the Bangor City Nursing Facility. The Administrator of the Bangor City Nursing
Facility shall be responsible for all admissions to the Bangor City Nursing Facility.
B. Monthly tR M City Manager. The A Imintstrator of the Bangor City Nursing Facility shall make a
report to the City Manager before the first Council meeting of each month as to the business A
his/her office during the preceding momm.
C. Other duties. The Administrator stall perform such other duties as may be prescribed by Me City
Manager Me Direcmr of the Office of Government Oneratons, or arty applicable state or local laws
and ordinances.
§ 2849. Parks and Recreation Director.
There Is hereby authorized and established the position of Parks and Recreation Director. This Position
shall be Included! in the Personnel Classification and Compensation Plan for the City of Bangor. The
Paris and Recreation Director shall supervise the entire operation of the Parks and Recreation
Department The Parks and Recreation Director shall be appointed by the City Manager on the basis of
mart and fitness alone, subject w the confirmation of the City Council.
A. Monthly report to the City Manager. The Parks and Recreation Director shall make a report to the
City Manager, before the first Council meeting of each month, as to Me business of his or her office
dump the pre¢tlirg month.
B. Other duties. The Parks and Recreation Director shall perform such other duties as may he
prescribed by the City Manager, the Director of the Office of Government: Ooeratiara. or any
applicable state or local laws and ordinances.
§ 28-64. Police Chief.
There is hereby authorized and established the position of Police Chief. This position shall be Included
In the Personnel Classification and Compensation Man for the City of Bangor. The Price CNA shall be
appointed by the City Manager on the basis of merit and fiches alone, subject M the confirmation of
the City Council.
A Responsible for law and order. The Police Chief shall be responsible for the enforcement and
maintenance of law and order and the protection of public safety and welfare.
B. Operation of the Police Department. The Police Chief shall be responsible for the entire operation
of the Police Department and the direction of the work force in accordance with the Police Chiefs
judgment. These duties shall include, but shall not be limited m, the operation of Me police forte;
direction of the working forces; the right to hire in accordance with city personnel rules; to
discipline, suspend or to discharge for jus cause; m change assignments; to promote; to transfer;
to maintain discipline; W establish work schedules; and to introduce new and Improved methods or
facilities. The police Chief shall be responsible for all aspects of § 28-53 above.
C. Ocher dudes. The Police Chief shall perform such other duties as may be prescribed by the City
Manager. the Director of the Office of Govamment Operations or any state or local laws and
ordinances.
§ 28-51. Director of Public Health and Welfare,
There is hereby authorized arid established the position of Director of Public Health and Welfare. The
Director of Public Health and Welfare shall supervise Me entire operation of the Public Health and
Welfare Department. This position shall be Included in the Personnel Classification and Compensation
Man for the City of Bangor. The Director shall he appointed by the Cry Manager on Me basis of merit
and fitness alone, subject W confirmation of the qty Council. The Director shall make a monthly report
to the Cry Manager as to the business of hisJher Department during the preceding month, shall
perform Me duties of the Director of Public Welfare as prescribed under this article and shall Perform
such other dudes as may he requiretl by the City Manager, the Director of the Office of Gevemment
Operations. or Me City Council from W time to time.
§ 28-58. Public Health Division; Health Officer; Children's Dental Clinic Test.
C. Health Officer. There is hereby authorized and established the position of Health Officer, whose
responsibility shall include the supervision of the Public Heats Nursing Division. This position shall
be included in the Personnel Classification and Compensation Plan for the City of Bangor. The
Health Officer shall be appointed by the City Manager on the basis of meat and fitness alone,
subject to confirmation by the City Council. The Health Officer shall have all powers and authority
provided by state aws and dty ordinances relating to Ms/her position. The Heats Officer shall
make a monthly report W the Director of Public Health and Welfare and Perform such other dudes
as may be prescribed by the qty Manager, Director of the Office of Government Operations.

§ 28-59. Public Welfare Division.

B. Director of Public Welfare. There is hereby authorized and established the position of Director of
Public Welfare, whose resporsibil'Nes shall include the supervision of the Public Welfare Divskin.
The Director of Public Welfare shall have all powers and authority proAded by state laws and city
ordinances relating he his/her position. The Director of Public Welfare shall make a monthly repot
W the City Manager and perform such aper duties as may be prescribed by the City Manager,_he

§ 28-62. Director of Puble Semmes the Office of Inhasiructum and Development Support
There is hereby authorized and established the position of Director of No! a Servi[es the Office nt

entire operations of the PnbNeiewieea43eperbnent Office. This position shall be induced in the
Personnel Classifintion and Compensation Plan of the City of Bangor. The DireUm of Pub! a-Se,le
the Office of Infrastructure and Development Support shall be appointed by the City Manager on the
basis of merit and fitness alone, subject to the confirmation of the City Council.
A. Other capactties. The Director of Public -Serve the Officeof Inhastructure and Development
Su mmt or his or hu duly authorbed agent, is hereby designated as Cry Engineer, City Electrician
ant Public Works Director and shall assume the pourers and duties conferred upon those positiora
under the laws and ordinances of the City of Bangor.
B. Monthly report to City Manager. The Director of Pub is Se !ams Nfrastructure and Development

A. Engineering Division.EN
(1) R shall b r the function of the Engineering Mislom
(a) Make surveys. To make surveys, including levels, prepare plans and profiles,
vnim specifications and perform other related engineering work in connection
with streets, sewers and other public structures.
(b) Construction of public structures. To make Quantity and cwt estimates, inspect
and approve the construction of public structures and perform all other related
engineering work for the city not specifically herein enumerated.
(c) Record new streets. To record nen streets as laid out in the Qty Road Book and
esablah the lines anti grades for building ries streets ant for regrading old
streets.
(d) Erection of monuments. To superintend the erection of monuments M the
intersection of streets and preserve and reset all street monuments disturbed or
liable W be disturbed in grading or building streets.
(e) Maintain records. To maintain and safely keep all engineering records,
instruments, plans, profiles, records of surveys and all other property and papers
relating to englrmering work of every description belonging to the City of Bangor.
(f) Services for other departments. To perform all engineering services for the Pub!ie
SoMEas-BepartneM.and -le wch ether departments anti offices of the aW as
may from time to time require such service.
(2) 'nle City Engineer shall supervise the entire operation of Me Engineering Division. In
addition to other dudes required by law, the Ory Engineer shall have Marge of and
regulate the opening and excavation of all city sheets and shall have the authority to
grant applications for the location of utility poles, wires and other W14 structures in the
public rights-ofR y, provided that the City Engine authority to grant utility location
permits shall not be in substitution for any franchise agreement or similar agreement
otherwise required by law, e.g., able television franchise agreements required under
30-A M.RS.A. 4 3000.
B. Public Works Division. It shall be the function of the
Public Works Division to perform construchon and maintenance of
city buildings and facilities; to provide municipal garbage and refuse disposal; to operate and
maintain municipal highways, municipal gravel pits, cemeteries and sanimtion facilities; and to
be responsible for and oversee the operation and maintenance of the city's harbors and
wharves. For purposes of performing such functions, the Operators and flaintereame Public
Worts Division shall be organized In sunt subdivisions as the Ory Manager may deem advisable
from time to time.
C. Electrical Division. it Mall be the fumtion of the Electrical Division to perform the operation and
maintenance of the sbeedlighting and taf0c lighting system, W operate and maintain the fire
and ponce alarm system and to perform related functions as may be assigned.

D. Planning Division. The Manning Division shall be responsible for the promotion and coordination
of the rational use of land in the city in accordance with the city's Comprehensive Plan.
E. Code Enforcement Division. The Code Enforcement Division shall be responsible for
administenng and enforcing all ordinances and state and federal statutes and programs coming
within its jurisdiction, including but not limited to the BOCA Basic National Building Code, BOCA
Basic Property Maintenance Code, state plumbing regulations, BOLA Basic Mechanical Code,
National Electrical Code, Chapter 165, land Development, of this Code, Chapter 71, Bangor
Center Revitalization Area, of this Code, the One- and Two -Family Dwelling Code and Chapter
148, Historic Preservation, of this Code.
§ 2864. Division heads.
There are hereby authodzed and established the Positions of division hears for the divisions
enumerated in § 2863 above. The division heads shall supervise the operation of their particular
division. The positlms shall be Induced in Me Personnel Clas ilficstion and Compensation Plan for the
CM of Bangor. The dwision heads shall be appointed by the City Manager on recommendation of the
Director of Public-Samees Infrastructure and Deyelooment Summit on Me basis of merit and these
alone.
A. Monthly report to Director of Public Semites. The division heads shall report to the Director of

A. Effective January 1, 1976, no person shall be qualified far hire or appointment to positions of
employment except for dark typists, deck stenographers, account chrks, cost accountants and
custodial workers of the Electrical Division and the Operations and -Maintenance Public Woks
Dhislonafthe PublieSeroessiDepartmwE, whether ona temporaryorpermanent status,
unless he or she shall, within six months of his or her date of hire, atablkh a permanent
domicile within a Ibor distance of the motor pool garage (Building No. 285), Bangor
International Airport, as shown on a map aspect October 15, 1975, entitled "Residency
Requirements; on file in the office of the City tiers and made a part hereof. The Period for
establishing a domidle hereunder may be extended far an additional Period not exceeding s&
months by the department head with approval of the City Manager. All qualifying penins so
hired or appointed shall continue to malntaln their domicile within said linear distance for Me
entire period of their employment with Me Oty of Bangor.
The requirements of Mis section shall not apply to More penins hired or appointed to such positions

with streets, sewers and other public structures.
(b) Construction of public structures. To make quantity and cost estimates, inspect
and approve the construction of public structures and perform all other related
engineering work for the city not specifically herein enumerated.
(c) Record new streets. To record new streets as laid out in the City Road Book and
establish the lines and grades for building new sheets and for regrading old
st ere s.
(d) Erection of monuments. To superintend the erection of monument at the
intersection of street and preserve and reset all sheet monuments disturbed or
liable to be disturbed in grading or building streets.
(e) Maintain records. To maintain and safely keep all engineering records,
instrument, plarm, profiles, records of surveys and all other property and papers
relating in engineering work of every description belonging m the City of Bangor,
(f) Services for other department. To perform all engineering services for the Pub'
Services Department and far such adv r departments and of the city as
may from time m time require such service.
(2) The City Engineer shall supervise the entire operation of the Engineering Division. In
addition to other duties required by law, the City Engineer shall have charge of and
regulate the opening and excavation of all city street and shall have the authority to
grant applications for one location of utility poles, wires and order utility structures in the
public rights-of-way, provided that the City Engineers authority W gram utility, location
permits shall not be in substitution for any banchise agreement or similar agreement
otherwise required by law, e.g., cable teledsion franchise agreements required under

within ds jurisdiction, including but not limited to the BOLA Basic Natlonal Building Code, BOCA
Basic Property Maintenance Cade, state plumbing regulations, BOLA Basic Mechanical Code,
National Electrical Code, Chapter 165, land Development, of this Code, Chapter 71, Bangor
Center Revitalization Area, of this Code, the One- and Tw Family Dwelling Code and Chapter
198, Historic Preservation, of this Cede.
§ 28-69. Division heads.
