Corner, Plymouth, Maine Waste Oil Consent Decree for Past Costs.

This Resolve authorizes the Finance Department to establish an account containing $76,557.22 and
to pay the City's obligation for EPA's past costs at the Haws Carrier, Plymouth Maine, Waste Oil Site
pursuant to the Consent Decree by October 31, 2000. This payment will cover costs already
incurred by EPA W safeguard the residents of Plymouth from contaminated materials associated
with the site. The majority of the more than $8 million expended relates to the installation of a
water system to serve residents.
The total amount due to the City is apportioned between the General Fund and the Airport. The
attached resolve appropriates $36,517.79 from Airport Reserves and $40,039.43 from the General
Fund. In the past, the General Fund share of such settlements has been taken from the City's
Reserve for Self -Insurance. As a result, the amount available in this reserve has steadily been
decreasing. The current balance in this reserve is slightly mom than $20,000, and additional
expenses are anticipated for this site in the future.
As a result, we recommend that the General Fund's share of these costs be appropriated from
undesignated fund balance. As we have previously reported to the Council, we are confident that
this balance will exceed policy goals as of the end of the last fiscal year.

RESOLVED, 77W. an amount of funds sufficient to cover the Consent Decree obligation In the
amount of $76,557.22 is hereby appropriated to an account to be established by the Finance
Director or Deputy Finance Director in order to fund the General Fund's portion of the Consent
Decree obligation for past costs associated with the Hows Comer, Plymouth, Maine, Waste Oil
Site. A total of $36,517.79 shall be appropriated from the Airport Reserves and a total of
$40,039.43 shall be appropriated from the General Fund's Undesignated Fund Balance. The
Finance Director, or Deputy Finance Director, Is hereby authorized and directed to pay the
Consent Decree obligation to the Consent Decree Trustee by October 31, 2000.
