Rem/Subject Authorizing the Discontinuance ofPartions of Bennett Street and Bildreth Street

Commentary:
Recently we have received a request from Schofield, Inc. to discontinue portions of Bennett
Street and Hildreth Street, which have never been constructed. Schofield is proposing to
develop a 14 -acre parcel at the end of the accepted portion of Hildreth Street. The parcel is
bordered north and east by the unbuilt portions of HBdreth and Bennett These portions
are not necessary for public need or to access other parcels. Upon discontinuance, land
occupied by the proposed street would revert to abutters and become taxable.
The attached council order represents the that step in the discontinuance process prescribed
by state statutes.
A sketch and memo from the City Solicitor regarding this issue is attached.

This proposal has been reviewed and recommended by the Municipal Operations Committee. Please
note dsattliese paper streets see not needed, whether this proposed development proceeds or not As
noted above, this is the first step in the discontinuance process. I saw recommend
approval.

ORDERED,
THAT
WHEREAS be portion of Hewett Street extending westerly from Hildreth Street and the
portion of Hildreth Street entmiling southerly from Bennett Street were proposed As
public streets in 1951, and;
WHEREAS these portions of Bewett Street and Hildreth Street have never been
con structol or accepted, and are no longer considered necessary to serve the public needs,
and;
WHEREAS, the City has received a ropiest to discontinue said portions of sheets;
NOW, THEREFORE BE IT ORDERED, that: the City Engineer be and is hereby
authorized and directM to begin the process of discontinuing the portion of Bennett Street
extending westerly from HildreN Street and the portion of Hildreth Street extending
somberly from Beweh Street in accordance with the provisions of 23 M.R.S.A. § 3026,
and submit awrimm report to be City Council for fuller action.

Scholfield, Inc. is proposing to develop a the recycling and construction and
demolition debris transfer facility at the end ofHildreth Street in Bangor. Attached isa
her map of the area-

reaScholfield, ine. has a purchase option for the Emery -Waterhouse 104 a 14 acre
parcel. The City owns a one acre parcel m the comer of lfildreth and Hewett Street.
Scholfield, Inc. would like to purchase the City lot. In 1947 the City installed a settling
tank and leach field on the lot Once the area bad public sewer the twk was no longer
used. The current condition of the taNc is unY own.
The lot is curmndy assessed at $63,000. If the lot were acquired as part of the
larger lot, the assessing department advises that the value of the Emery -Waterhouse lot
would increase by $9,105.
The developer is also requesting that the City vacate Ne paper street portions of
Hildreth and Bowen Street. This request will be considered by the Municipal Operations
Committee. The primary reason for that request is for additional land to be used to meet
setback requirements.
The recycling and harsher facility is estimated to cost $250,000 and employ as
many as ten (10) people.
These requests will be on the nett C&ED and Municipal Operations Committee
agendas.
