(TITLE.) Ordinance, Amending the Code of the City of Bangor, Chapter 252, Sewers and
Drains, 4 252-7.

J 252-7. Installation and connection to public sewer, utaintevence of private
lines.
A. All costs and expenses incident to the installation and connection of the
building sewer shall be borne by the owner. The owner shall indemnify the city from
any loss or damage that may directly or indirectly be occasioned by the installation of
the building sewer.
B. A separate and independent building sewer shall be provided for every building,
except where one building stands at the rear of another on an interior lot and no
private sewer is available or can be constructed to the rear building through an
adjoining alley, court, yard or driveway, in which case the building sewer from the
front building may be extended to the rear building and the whole considered as one
building sewer.
C. Old building severe may be used in connection with new buildings only when
they are found, on examination and test by the city, to meet all requirements of this
chapter.
D. The size, slope, alignment and materials of construction of a building sewer
and the methods to be used in excavating, placing of the pipe, jointing, testing and
bac Willing of the trench shall all conform to the requirements of the Building and
Plumbing Codes or other applicable rules and regulations of the city or state. In the
absence of code provisions and in amplification thereof, the materials and procedures c
set forth in appropriate specifications of the ASTM and E F Manual of Practice No. 9
shall apply.
V. w6henever possible, the building sewer shall be brought to the building at an
elevation below the basement floor. In all buildings in which any building drain is too
low to permit gravity Dow to the public sewer, wastewater carried by any such
building drain shall be. lifted by a means approved by the city and discharged to the
building sewer.

F. No person shall make connection of roof downspouts, exterior foundation
drains, areaway drains or other sources of surface runoff or groundwater to a
building sewer or building drain which in tum is connected directly or indirectly to a
public sanitary sewer.
G. The applicant for the building sewer permit shall notify the city when the
building sewer is ready for inspection and connection to the public sewer. The
connection shall be made under the supervision of the City Engineer or the
Superintendent.
H. All excavations for building sewer installation shall be adequately guarded with
barricades and lights so as to protect the public from hazard. Streets, sidewalks,
parkways and other work shall be restored in a maturer satisfactory to the city.

MEMORANDUM

SUBJECT: Sewer Service Maintenance Policy
At the February 9 Sewer Committee meetiag, the Committee indicated an interest in
further discussing policy regarding maintenance of private sewer service lines. Staff has
previously provided information about ourent City policy and that of many comparable
communities, which generally places all responsibility for private sewer line maintenance
with the property owner.
As we further consider this issue, a basic polity decision needs to be made as to
whether or not the City should assist or participate in the expense of maintaining or
replacing private sewer service lines. If the decision is to maintain current policy,
keeping all maintenance responsibility with the property owner, then the Sewer
Ordinance should be amended to clarify this. John Ramer has prepared such an
amendment. If there is a desire for the City to assist in maintaining service lines, the
following needs m be considered:

Under what circumstances would City participation be considered (type of work,
etc.)?
Lean Assistance
A low burred[ loan program could be established within the sewer fund to provide
financial assistance in economic hardship situations. Eligibility criteria could he
similar to the Community Development Home Rehabilitation Program, as was
outlined in my 2/09/00 memo to the committee.
Direct City Participation
If the City is to become directly involved in sharing some of the expense associated
with murmuring private sewer services, staff recommends that it only apply to
unusual or "greater than normal length" situations. Staff also feels that participation
should be limited to situations where complete line replacement is necessary, rather
than for spot repairs, etc., and only for private residential dwellings (2 units or less?).
We have developed a couple of possible alternatives for your consideration:

1. COST PER FOOT CREDIT
Under this option, the City would credit the property owner $50 per linear
foot for that portion of the service line which extends more than 10 fret beyond
the cee<erlme of the street pavement, and exceeds 45 feet of service line
replacement Applying these coterie world identify those situations, which are
beyond the normal service line installation scenario. We would propose that
assistance determined under Us option would be credited against the
homeowner's sewer bill(s).
2. STREET OPENMG PERMIT FEE LIMIT
Under this option, we would not charge any additional street opening
permit unit costs ($50 per square yard) for the portion of service line extending 10
feet beyond the centerline of the roadway pavement. As in Option 1), we would
recornmend that service line replacement be at least 45 feet in order to be eligible
for this benefit. This particular option would be any to administer, as it would be
determined when the street-operdng permit is issued, which results in an up -front
benefit to the homeowner prior to the annual work being done. It also splits the
financial responsibility for "long aide' portions of service lines between the
homeowner and the City. In a typical "long side" siNation where a service
extends across the entire street width, the savings to the property owner would be
$300 to $400.
I will outline these options in greater detail at the 3/8/00 sewer wmuottee
