ORDER, Authorizing Second Amendment to Lease with the State of Maine, Military Bureau Responsible Department: Legal On April 14, 1997 by Council Order 92-186, the City Council approved a lease between the Qty of Sargor and the State of Maine, Military Bureau. The lease provided that the City could terminate it If the Lessee stripped using the property for aernauhc'ul uses or If the Lessee cid not make the promlsed improvements W the property within five years. For the project to move forward, the Federal Government requires that the Maine Attorney General's Office cemfy that the lease have no conditions or restrictions that would allow the City to terminate the lease before the end of the lease term. This Second Amendment removes those early termination provisions. In the event that the STATE's aeronomical nee of the premixs ceases, the CITY may terminate the Lease by giving thirty (30) days notice in writing to the STATE." And by deleting paragaph 9 and replacing it with "B. It is the understanding of both of the parries hereto that the purpose of Us lease is to allow the United States to make permanent improvements to the existing aircraft apron and other portions of the premises, said improvements to have an expected project cost of approximately Twelve Million Dollars ($12,000,000) and are expected to be substantially completed in approximately Five Years. In all otl a respects the Lease between the parties remains in full force and effect except that paragraphs may be remmmbmed.
