WHEREAS, The CRy's applications to the Federal Aviation Administration and the Maine
Department of Transportation for Airport Improvemem project gram funds to make
Improvements to the infrastructure at Bangor International Airport have been accepted and the
Federal Ablation Administratrlan and the Stale of Maine have agreed to provide the funds; and
WHEREAS, Federal funds will cover 90% of the cost of the project with an additional 5%
coming from the State of Maine and 5% from the Airport,

Government, Federal Aviation Administration and the State of Maine, Department of
Transportation grants for the design phase of the rehabilitation of runway 15-33, taxiways K &
M and taxiway 'A# north and south hold aprons (ATP 30); and
RES'OL VED, There is hereby appropriated within the Airport Fund the amount of $321,220
recognizing state and federal grant funds and Airport Department budgetetl funds to used for
sald project.
The City Finance Director Is hereby authorized to place these amounts wiythln the appropriate
accounts.

Transportation, Office of Passenger Transportation, hereinafter
referred to as the 'Department")
WHEREAS, the Spenser has submitted to the Department a Project Pre -application
r Request for Aid involving a grant Of State fonds for a project for the
acquisition, construction, establishment, safety, expansion, improvement Or
protection of the lannaur Irubootirnul Mxwrt (hereinafter called the
^Airport•). -
WHEREAS, the Department has approved a project based upon this request for
development of the Airport (hereinafter called the ^ProjecV) consisting of
the followfug described airport development: _
Terminal apron reconstruction.
NOW THEREFORE, pursuant t0 and for the purposes of carrying out the provisions
of 6 M.R.S.A. §17.1, 17.9, and 418.1, and in consideration of (a) the
Sponsor's atceptance of this Offer, as hereinafter provides and (b) the
benefits tos a to the public from the accomplishment of the Project and
the operation and maintenance of the Airport, as. herein provided.

THE DEPARTMENT, FOR AND ON BEHALF OF THE STATE OF MAINE, HEREBY OFFERS AND
AGREES to pay, as the State's share of coats incurred in accomplishing the
Project, 38 percent of all approved project costs, subject to the following
terms and conditions:
1. The maximum obligation of the State payable under this Offer shall

a. Begin accomplishment of the Project within a reasonable time
after acceptance of this Offer, and

revised Or modified with the approval of the Department, and

Department and;
I. Operate the Airport for the use and benefit of the public on
fair and reasonable terms without unjust discrimination, and
g., Insofar as is within its power and reasonably possible, the
Sponsor will prevent the use of any land either within or outside the
boundaries Of the Airport in any manner (including the construction, creation,
alteration, or growth Of any structure or other object thereon( which would
Bate a hazard to the landing, taking off, oring of aircraft at the
Airport, or otherwise limit the usefulness Of the Airport.
3. The Sponsor certifies that it holds property interests in the areas
Of land which are to be developed or used as a part of Or to connection with
the Airport.
4. The Sponsor shall keep So accurate accounting of all costa incurred
n the Project and submit a copy of such accounting to the Department upon its
request for reimbursement of such costs by the Department.
5. This Offer shall expire and the State shall not be obligated to pay
any of the tests of the Project unless this Offer has been accepted by the
Sponsor within sixty (60) days from the above date of Offer or such longer
time as may be prescribed by the Department in writing.
6. The Sponsor agrees to conscientiously perform preventative
maintenance on the completed project and to make no application for State
funds for repair or replacement of the Project as a result of failure to
perform such maintenance.
The Sponsor's acceptance of this Offer shall be evidenced by execution of this
nstr ent by the Sponsor, as hereinafter provided and said Offer and
acceptance shall comprise a Grant Agreement constituting the obligations antl
rights of the State and the Sponsor sift respect to the accomplishment
omplishment of the
Project and the operation and maintenance of the Airport. Such Grant
Agreement shall become effective upon the Sponsor's acceptance of this Offer
and shall remain in full force and effect throughout the useful life of the
facilities developed under the Project but in any event not t0 exceed ten (10)
years from the date of said acceptance.

The Offer is made on and subject to the following terms and conditions:
Conditions
1. The narimum obligation of the United States payable under this offer shall be
$289,096.00. For the purposes of any future grant amendments which may increase the
foregoing Paulson, obligation of the United States under the provisions of Section 47108(b)
of the Title 49 U.S.C., the following amounts are being specified for this purpose.
$00.00 for planning
$289,098.00 for airport development or noise program implementation.
2. The allowable costs of the project eMll not include any costa determined by the PAA
to be ineligible for consideration as to allowability Under Title 49 U.S.C.
3. Payment of the United States share of the allowable project costa will be made
pursuant to and in accordance with the provisions of such regulations and procedures as the
Secretary shall prescribe. Final determination of the United States share will he based
upon the final audit of the total amount of allowable project and settlement will he
made for any upward or downward adjustments to the federal share of coats.
4. The sponsor shall carry out and complete the project without undue delays and i
accordance with the terms hereof, and such regulations and procedures as the Secretary Shall
prescribe, and agrees to comply with the assurances which were made part of the Project
application.
S. The FAA reserves the right to amend or withdraw this offer at any time prior t0 its
acceptance by the sponsor.
6. This offer shall mire and the United States shall not be obligated to pay any part
of the costs of the project =team this offer Me been accepted by the sponsor on or before
September 21, 2001, or such subsequent date as may be prescribed in writing by the FAA.

]. The sponsor shall take all steps, including litigation if necessary, to recover
Federal funds spent fraudulently, wastefully, or in
violation of Federal antitrust statutes,
or misused i any other masher in any project upon which Federal funds have been expended.
For the purposes of this grant agreement, the term "Federal funds- means funds however used
or disbursed by the sponsor that we originally paid pursuant to this or any other Federal
grant agreement. It shall obtain the approval of the Secretary as to any determination of
the amount of the Federal share of such funds. it shall return the recovered Federal share,
Including funds recovered by settlement, order or judgment, to the Secretary. It shall
tarnish to the Secretary, upon request, all documents and resorda pertaining to the
determination of the amount of the Federal share or to any settlement, litigation,
negotiation, or other efforts taken to recover such funs. All settlements o other final
positions of the sponsor, in court o f otherwise, involving the recovery of Federal
share shall be approved in advance by the Secretary.
8. She United States shall not be responsible or liable for damage to property or injury
to persona which may arise from, or he incident to, compliance with this grant agreement.
9. Buy American Requirement: Unless otherwise approved by the FAA, the sponsor will not
acquire or permit any contractor o subcontractor to acquireany steel o manufactured
products produced outside the United States to be used for any project for airport
development or noise compatibility for which funds are provided under this grant. The
Sponsor will include in every contract a provision implementing this special condition.
10. He reimbursements will be made under this grant agreement until the independent cost
estimate process is completed and the engineering contract is reviewed and approved by Fan.

Application incorporated herein shall be evidenced by execution Of this instrument by the
Sponsor, as hereinafter provided, and this Offer and Acceptance shall comprise a Grant
Agreement, as provided by Title nz V.S.C., constituting the contractual obligations and
rights of the United Star" and the Sponsor with respect to the accomplishment of the
Project and compliance with the assurances and conditions as provided herein. Such Grant
Agreement shall beeffectiveupon the Sponsor's acceptance of this Offer.

GENERAL PROJECT DESCRIPTION
This gram application is for the rehabilitation design of Runway 15-33, Taxiway'Kand Taxiway'M'. Also included
is the engineers cost for advertisement bidding and arrangements for construction and the engineer's and
sponsors project administration mats. A separate gram application will be subm8led forlhe engineers construction
administration and the actual construction costs.
The proposed project will rehabilitate the airport's runway and Taxiway's'K' and'M'. Rehabilitatwn of RNV 15-33
vall include narrowing the runway vndth tram 300 feet to 200 feat, repairing and replacing deteriorated PCC slabs
and construction of a proposed 5' P401 Pavement overlay. Taxiways'K' and' M' rehabilitation *11 consist of milling
5' of the existing deteriorated PCC, us& and sealing the milled PCC slabs, construction of a I' P401 leveling
course, installation of SAMI (stress absorbing membrane intarthe r) and a 3' P401 pavement overlay. Taxiways
'K' and 'M' shoulder pavement will consist of 3' of P401 and S' of P-209. The RAN 33 end safety area length
beyond the runway will be regraded and paved with 3' of PA01 and 6' of P-209. The re -grading is required to
remove ground interference to the PAN 15 locwlizer
Electriml upgrades in coordination with the phased construction and narrowing of the RAN will be incorporated in
to the design. Electrical upgrades include upgrade of the airport's electrical vault to bring A to current electrical
standards, a new emergency generator, new circuit cables and lighting for the runway, Taxiway'K' and Taxiway
'M'. An additional new circuit will be provided for Tanoway'L' which currently shares a circuit with a portion of
Texiway'A'.
Incorporated into the design will be the FAA's upgrades to the airport's NAVAIDS. Edwards and Kelcey will
incorporate the FAA's plans and specifications into the bid package. NAVAID designs include movement of the
RAV 15 approach localizer out of the safely area onto a nen foundation; upgrading and movement of the RAN 33
localizeq installation of new elevated MALSR light stations in the Rat 33 safety area; movement of the RAV 15
ALSF-2, and movement of the RAN PAPI's.

GEOGRAPHIC LOCATION
Bangor International Airport is located just east of the central portion of the State of Maine in Penobscot County.
The Airport is two miles from dovntown Bangor and approximately 25 miles tram the Atlantic coast The primary
service area of the Airport includes the cities of Bucksport, Old Town, and Orono and other towns within a 3a mile
radius. The secondaryservice area includes a much larger portion ofthe State since His one of Ne State's two
airports currently serviced by certified air carriers and is a U.S. Customs portofentry. The Airport also services
supplemental air carriers.

CERTIFICATION REGARDING DRUG-FREE WORKPLACE REQUIREMENTS
Afternatel. (Grantees Other Than Individuals)
A. The grantee certifies that it will or will continue to provide a drug-free work
place by:
(a) Publishing a statement notifying employees that the unlawful
manufacture, distribution, dispensing, possession, or use of a controlled
substance is prohibited in the grantee's workplace and specifying the actions that
will be taken against employees for violation of such prohibition:
(b) Establishing an ongoing drug-free awareness program to inform
employees about -
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining a drug-free workplace;
(3) Any available drug counseling, rehabilitation, and employee
assistance programs; and
(4) The penalties that may be imposed upon employees for
drug abuse violations occurring in the workplace;
(c) Making it a requirement that each employee to be engaged in the
performance of the grant be given a copy of the statement required by paragraph
(a);
(d) Notifying the employee in the statement required by paragraph (a)
that, as a condition of employment under the grant, the employee will -
(1) Abide by me terms of the statement; and
(2) Notify the employer in writing of his or her conviction for a
violation of a criminal drug statute occurring in the workplace no later than five
calendar days after such conviction;
(e). Notifying the agency in writing, within ten calendar days after
receiving notice under paragraph (d)(2) from an employee or otherwise receiving
actual notice of such conviction. Employers of convicted employees must
provide notice, including position title, to every grant officer or other designee on
whose grant activity the convicted employee was working, unless the Federal
agency has designated a central point for the receipt of such notices. Notices
shall include the identification number(s) of each affected grant;
(f) Taking one of the following actions, within 30 calendar days of
receiving notice under paragraph (d)(2), with respect to any employee who is so
convicted-

(1) Taking appropriate personnel action against such an
employee, up to and including termination, consistent with the requirements of
the Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactonly in a
drug abuse assistance or rehabilitation program approved for such purposes by
a Federal, State, or local health, law enforcement, or other appropriate agency;
(g) Making a good falth effort to continue to maintain a drug -tree
workplace through implementation of paragraphs (a), (b), (c), (d), (e), and (f),

(Hereinafter referred to as the "Sponsor")
FROM: The State of Maine (acting through the Department of
Transportation, Office of Passenger Transportation, hereinafter
referred to as the "DepartemtY)
WHEREAS, the Sponsor has submitted to the Department a Project Pre -application
r Request for Aid involving a grant of State funs for a project for the
acquisition, construction, establishment, safety, spja nsicn, improvement or
protection of the Became International Aiioert (hereinafter called the -
"AirporY).
WHEREAS, the Department has approved a project based upon this request for
development of the Airport (hereinafter called the 'Project-) consisting of
the following described airport development
Phase I Design Of: Rehabilitate, mark and light Runway I5-33: Pelubilitate
Taxiways ^R" and 7MS.
NOW THEREFORE, pursuant to and for the purposes of carrying out the provisions
of 6 M.R.S.A. 517.1, 11.9, and 515.1, and in consideration of (a) the
Sponsor'a acceptance of this Offer, as hereinafter provides and (b) the
benefits Loe a t0 the public from the accomplishment of the Project and
the operation and maintenance of the Airport, as herein provided.

THE DEPARTMENT, FOR AND ON BEHALF OF THE STATE OF MINE, HERESY OFFERS AND
AGREES to pay, as the State's share of Costs incurred in complishing the
project, Be percent of all approved project costs, subject to the fallowing
terms and conditions:
1. The maximum obligation Of the State payable under this Offer shall
be: 6' One D 1.00 30 .
2. Sponsor shall --
a. Begin accomplishment of the Project within a reasonable time
after acceptance Of this Offer, and;
b. Carry out and complete the Project in accordance with the terms
Of this Offer, and;
C. Carry out and complete the Project in accordance -with the plane
or sketches and specifications as approved by the Department or as they may be
revised Or modified with the approval of the Department, and;
d. Take necessary legal action to revoke any and all existing
non
-aeronautical rights of way or encumbrances across the lending strip and

prevent the issuance of any further such permits or rights of way t cross
said strip, anduan
e. Pursuant to 6 M.R.S.A., operate and maintain the Airport and all
facilities thereon or connected therewith which are necessary for airport
purposes, and not permit any activity thereon which would interfere with i
e for aeronautical purposes except with the prior written approval of the

Department and;
I. Operate the Airport for the use and benefit of the public on
fair and reasonable terms without unjust discrimination, and
g. Insofar as is within its power and reasonably possible, the
Sponsor will prevent the us, Of any land either within or Outside the
boundaries of the Airport in any manner (including the construction, creation,
alteration, or growth of any structure or other Object thereon) which would
sate a hazard to the landing, taking off, or maneuvering of aircraft at the
Airport, or Otherwise limit the usefulness of theAirport.
S. The Sponsor certifies that it holds property interests In the areas
of land which are to be developed or used as a part Of or in connection with
the Airport.
4. The Sponsor shall keep an accurate accounting of all costs incurred
rn the Project and submit a copy Of such accounting to the Department upon its
equest for reimbursement of such costs by the Department.
5. This Offer shall expire and the State shall not be obligated to pay
any of the costs of the Project unless this Offer has been accepted by the
Sponsor within Sixty (60) days from the above date of Offer Or such longer
time an may be prescribed by the Department in writing.
6. The Sponsor agrees to conscientiously perform preventative
maintenance On the completed project and to make no application for State
funds for repair or replacement of the Project as a result of failure to
perform such maintenance.
The Sponsors acceptance of this Offer shall be evidenced by execution of this
instrument by the Sponsor, as hereinafter provided and said Offer and
acceptance shall comprise a Grant Agreement constituting the obligations and
rights of the State antl the Sponsor with respect to the accomplislosent
omplishment of the
Project and the operation and maintenance of the Airport. Such Grant
Agreement shall become effective upon the Sponsor's acceptance of this Offer
and shall ressin in full force and affect throughout the useful life of the
facilities developed under the Project but in any event not to exceed ten (10)
years from the date of said acceptance.

The City Of Bangor does hereby ratify and adopt all
statements, representations, warranties, covenants, and agreements contained
n the Project Application and incorporated materials referred to in the
