Responsible Department: Legal last monM Hammond Street Courtyard, L.P., owners of the former Bangor Furniture Building on Hammond Street, entered into an agreement with Peoples Heritage in older to provide them with certain Ingress and egress over and across property of peoples for purposes of maintaining an exismg air duct on its property. Hammond Street Courtyard has now requested the City, as a mortgage holder, to assent to this easement. This assent does not affect the City's rights under its 19% mortgage far the rehabilitation and development of the property. The Business & Economic Development Committee considered this item at its meeting on February J, 2001 and recommends approval. Barrett, City Manager, is hereby authorized, on behalf of the City of Bangor, to execute and deliver a certain Assent to Reciprocal Easement Agreement to Hammond Street Courtyard, LP., for purposes of certain ingress and egress to the fomler Bangor Furniture Building on Hammond Sheet. A copy of said Assent to Reciprocal Easement Agreement Is attached hereto and is incorporated herein by reference. Assigned b nfLZP, Q"Qy,,,1 Councilor ASSENT TO RECIPROCAL EASEMENT AGREEMENT KNOW ALL MEN BY THESE PRESENTS, That CITY OF BANGOR a Maine municipal corporation having its principal office at 73 Harlow Street, Bangor, County of Penobscot, State of Maine, the owner and holder of a Mortgage which cons itutes a Lien against certain real estate located at Bangor, County of Penobscot, State of Maine, described in a Mortgage Deed dazed lune 29, 1998, recorded in the Penobscot County Registry of Deeds in Back 6734, Page 223 to which reference may be had for a statement of the temss and conditions of said Mortgage and a description of the mortgaged premises, both being incorporated herein by reference with the same effect as if fully set forth herein; that the Grantor in said Mortgage Deed, Hammond Street Courtyard, L.P., who by Reciprocal Easement Agreement dated January 17, 2001, conveyed to Peoples Heritage Bank N.A., certain rights, privileges and easements therein fully act forth, which Agreement is to be recorded herewith at said Registry of Deeds end to which reference is made for a statement of the rights, privileges and easements so conveyed; that for consideration given, the receipt whereof is hereby acknowledged, the undersigned owner and holder of said Mortgage, does hereby assent to the granting as aforesaid of mid rights, privileges and easements and to the exercise thereof by said PEOPLES HERITAGE BANK N.A., a national banking corporation organized according to law and having an established place of business at Portland, Maine, its successors and assigns, forever, free from the lien and operation of the aforesaid Mortgage.
