At the same time, McChesney's lot on the Silver Road was purchased by Jon and Nancy Dawson. Dunng the title search a 1989 has lien was discovered that had been paid but not discharged at the tlme of payment. Because the lien had matured, Caundl approval is needed to release any interest the City may have in the property by NM1ue of the lien. DAWSON and NANCY S. DAWSON 1T, both of Bangor, Penobscot County, Maine, as Grantces, successors in interest to Earl M. and Marie O. McChesney, a certain lot or parcel of land with the buildings therear, situate in the City of Bangor, Penobscot County, Maine, and more particularly described as follows, viz: Situated on the westerly side of Silver Road in said Bangor, at Fairmount, so-called, and being lot numbered two hundred and thirty-one (23 1) according to plan of P.H. Coombe, C.E. made for the Fairmount Realty Association and recorded in the Penobscot County Registry of Deeds Plan Book No. 8, Page 37, hereby returned to for amore particular description of the premises. Provided however that this conveyance is made subject to the conditions, obligations and restrictions hereinafter expressed and imposed upon said Grottoes, their hens and assigns, viz: upon the express condition that no building shall ever be exacted upon the parcel of laud herein conveyed except a private dwelling house and the necessary outbuildings thereof; and upon the further express condition that no private dwelling house shall ever be erected, placed or maintained upon said parcel of land which dwelling house it itself, exclusive of any stable or outbuilding shall cost to build less than Three Thousand ($3,000) Dollars; and also upon the further express condition that no building shall many time be erected on said premises the front wall of which or the windows, piazzas, steps or porticoes of which shall be within fifteen (15) fact of the sweet adjoining the same. Any and all other rights, easements, privileges and appurtenances belonging to the granted estate are hereby conveyed. The purpose of this deed is to release to the Grantees any interest the Grantor may have in the above-described property by vitae of an undischarged real estate tar lien assessed against Earl M. and Marie O. McChesney for the year 1984 and recorded in Book 3524, Page 205, Penobscot Registry of Deeds All public easements or other public interests in the described premises for roads, sewers, or other purposes are expressly reserved. The said CITY OF BANGOR has caused this instrument to he sealed with its corporate seal, and signed in its corporate name by RONALD L HELLER, Finance Director, thereinto duly authorized thisday of February, 2001.
