Commentary:
Over the but couple of years there has been an increasing number of sewer abatement requests due to
leaking furores and similar reasons. Many of these have been from apartment complexes with absentee
landlords, some of which have made multiple requeAs per year.
The attached Ordinance Revision would tighten the criteria under which abatements may be granted, and
Further defines "due care" end responsibilities of the ratepayer.

Be it ordained by the City CouneU of the City of Deeper, as follna n
Chapter 252, Section 25 of the Code of the City of Bangor, Sewers and Drains is
hereby amended as follows (additions are underlined):
A. Abatements of sewer use charges may be granted by the Superintendent of the
wastewater treatment plant upon application of a ratepayer, where the ratepayer
can demonstrate that a lass of water occurred due to no fault of the ratepayer, his
or her agents or employees. Abatement requests from commercial novelties will
be considered only if the loss of water was from building services (furnace toilet
water beater etc) not from equipment used in the course of business or vans
otherwise allowed by Section 252-25 I of the Bangor Cade Ratepayers are
responsible for exercising due care m the maintenance of their water and sewer
systems to prevent water losses. For purposes of abatement, "due rare" shall be
defind as the normal and reasonable steps, which would be taken by a prudent
individual in operating and maintaining his or her sewer systems. A morwoovt

Chapter 252, Section 25, is hereby amended by deleting paragraph A and replacing with
the following:
A. Abatements of sewer use chmges may be granted by the Superintendent of the
wastewater treatment plant upon application by a ratepayer of an owner occupied
property, where the ratepayer can demonstrate that a loss of water ocermed due in no
fault of the ratepayer, his or her agents or employees. Abatement requests from
commercial properties will be considered only if the loss of water was from building
services (Comate, toilet, water heater, etc.) not Prom equipment used is the course of the
