ORDERED, That the City of Bangor Advertising Policy, Council Order 89-92 as adopted on February 13, 1989, is hereby amended by adding the following section 2.7 as follows: 2.7 The Pickering Square Parking Garage, with preference for advertising from businesses operating within the Bangor Center Development District. Responsible Department: City Council Commentary: Among its other recommendations, this yeses Special Committee on Parking recommended that consideration be given to permitting advertising in the Pickenng Square Parking Garage. in addition, Councilor Tremble, Committee Chair, suggested that consideration should also be given to limNng and/or providing Priority to downtown businesses for this purpose. Under our current advertising policy, the garage is not included as a location permitting advardsing. Please see the attached memo that discusses this issue In greater detail. At its last meeting, the Business and Economic Development Committee voted to recommend that advertising be permitted at the garage with priority to downtown businesses. The attached order would amend our Policy to permit this. At the same 6me, the Committee also discussed providing a discount to downtown businesses which choose to make use of this opportunity. Under our polity, fees for advertising must be approved by the appropriate Council Committee. As this project moves forward, staff will develop a fee sdtedule taking into consideration the Committee's discussion and return this schedule to the Committee. In order to begin this process, I would recommend your approval of the attached order, as does the Business and Economic Development Committee. Barrett Su: Advertising— Pickering Square Garage The recently submitted report of this year's parking advisory committee suggested that the City consider selling advertising space In the Pickering Square Garage. As a part of that recommendation, the issue of whether such advertising, if permitted, should be limited W Downtown businesses was raised. Under the City's adopted policy (attached), advertising is generally prohibited except in specifically, identified locations or under specifically outlined circumstances. In addition, certain types of advertising are not permissible, including tobacco and alcohol. At the Present time, Pickering Square is not on the list of permissible locations for advertising. The first question which must be answered is whether advertising should be permittetl. A review of the anent policy genemily indicates that advertising is permitted in a number a enterprise fund facilities, including the Auditorium, Bass Park, the Golf Course, and Bangor Ntema conal Airport. In addition, it is allowed on City buses. It is not permitted in general fund supported facilities except under very limited and specific dramstances. Generally speaking, it appears that the panting garage an be considered for advertising given the fad the it is an enterprise fund. As wch, the expectation is that the parking system will be operated on a more commercial basis and the we should attempt W improve its revenue stream wherever possible and reasonable. ps a result, we would recommend that advertising be permitted and that our advertising policy be amended to include the Pickering Square Garage as an authorized location. The next question is whether such advertising should! be Iimitad to businesses with a presence in the Downtown area. If we could be assured that such a limitation would still allow us to rent Ne space that might be available for such advertising, this might be an appropriate approach. At the present time, however, we do not know the level of demand that will exist. As a result, I would recommend that the Committee adopt a policy which would give priority to advertisers with a presence in the Downtown but not exclude the potential for other advertisers W rent space should downtown demand not be sufficient. This would allow us W "test the waters" of Downtown demand without totally foreclosing the option a considering other advertisers should space be available. We look forward to discussing this issue with you on Tuesday Edward A. Barrett City of Bangor Advertising Policy 1.0 Purpose Policy No. G 1.0 O2—%1 To establish the conditions under which commercial advertising will be permitted in City Facilities or on City equipment or property. 2.0 Policy Advertising is generally prohibited in City facilities or on City property except for: 2.1 The interior of the Bangor Auditorium; 2.2 The grandstand area in Bass Park; 2.3 The municipal Golf Course; 2.4 Bangor International Airport; 2.5 City buses; 2.6 Scoreboards associated with City sporting facilities such as softball fields or hockey rinks. 3.0 Conditions for Approval Commercial advertising will be permitted under the following conditions: 3.1 A fee or other valuable cusideration must be paid i accordance with a schedule of fees approved by the appropriate Council Committee; 3.2 Advertising is placed in an area or areas approved by the appropriate Council Committee; 3.3 A signed agreement exists between the City and the advertiser; 3.4 The City retains approval of the advertising copy o display, such approval to he at the discretion of the appropriate City Department Heads; 4.0 Other 4.1 No political advertising of any kind or character shall be permitted except for paid political advertising on City busses and signs and posters displayed during political events at the Bass Park Facility where a fee has been charged for use of the Facility. 4.2 No tobacco product advertising shall be permitted; 4.3 Advertising for alcoholic beverages will be permitted only where such beverages are sold o at special events sponsored by the manufacturer or distributor of such beverages. 02-%1 4.4 The Director of Parks and Recreation is authorized to permit temporary advertising in City parks o other facilities under his/her control during events allowed by the City and sponsored in whole or in part by the commercial firm displaying such advertising; 4.5 The Director of Parks and Recreation is authorized to permit advertising on the grounds of Bass Park during the Bangor State Fair in conjunction with commercial o agricultural displays which constitute a integral part of the Fair or in conjunction with events approved by the Director and occurring under commercial sponsorship; 4.6 advertising may be permitted onscoreboards. Informational signs other equipment where such items are donated to the City in return, in whole or in part, for such advertising. The acceptance of such signs and advertising must be approved by the City Department Head responsible for the facility or property on which such sign/scoreboard is to be placed and have the concurrence of the appropriate Council Committee. Permission for rsuch advertising shall be either for a fixed term or for the useful life of the item donated, whichever is less. 4.7 any additional exceptions to this Policy must be reviewed and approved by the City Council. 4.8 Bulletin Boards. Limited advertising may be allowed o bulletin boards i n City facilities where such advertising has been approved by the Department or Division Head responsible for the facility. This will extend to notices of items for sale by City employees. 5.0 Responsibility for Ravinx The Director Of Administration shall review this policy at least annually, and shall maintain an inventory of all advertising.
