The purpose of this proposed ordinance amendment is to increase the maximum height of principal and
accessary structures in the Downtown Development District (DDD) adjacent to tidal waters fram 35 feet
to 80 feet. The current height limb of 35 feet for structures along Kenduskeag Stream in the Downtown
Development District makes many buildings non -conforming structures. The proposed height limit of BD
feet in the Downtown Development District, which is permissible under State -mandated Shoreland
zoning, will make these structures conforming and make the DDD standard consistent with that of the
Government and Institutional District

Section 165-37. Principal and accessory structures.
B. Principal or accessory structures and expansion of existing structures shall not
exceed 35 feet in height, except in the Downtown Development Distrix and
Government and Institutional Service District adjacent to tidal waters, where the
building height shall not exceed 80 feet This provision shall not apply to
structures such as transmission towers, windmills, antennas and similar structures
having no floor area
