Itam/Su0jecti RESOLVE, to accept the United States Government, Federal Aviation
Administration, the State of Maine, Department of Transportation and the National Guard
Bureau grants far the rehabilitation of runway 15-33, taxiways K & M and north and sourth hold
apron and acquire security equipment (A[P 31) and appropriate the grant funds for the purpose
of said projects.

Commentary: This Is the first part M the funding of the runway improvement project and the
purchase of the fingerprinting machine. The total project cost Is $17,352,045. The pry's share
of $500,000 was approved in the 2002 budget Only funded construction will to time at this
time.

ADMINISTRATION THE STATE OF MAINE DEPARTMENT OF TRANSPORTATION AND THE
NATIONAL GUARD FOR THE REHABILITATION RUNWAY 15-33
TA)1WAYS K & M AND NORTH AND SOUrH HOLD D ACQUIRE SECUR1TY
EOUIPMENT (AIR 31) AND APPROPRIATE THE GRAM FUNDS FOR THE PURPOSE OF SAID
PROJECTS.
WHEREAS, the drys applications to the Federal Aviation Administration, the Mahe
Department of Transportation and the National Guard Bureau for Airport
Improvement Project grant funds to make Improvements to the infrastructure at
Bangor International Airport and purchase security equipment have been accepted
and the Federal Aviation Administratrion, the State of Maine and the Air National
Guard have agreed to provide the funds; and
WHEREAS, this first funding will over $2,198,732 of the Federal portion of the project,
$122,152 of the State of Maine portion of the project and $5,000,000 of the
National Guard Bureau portion of the the project; therefore

rehabilitation of runway 15-33, taxiways K A M and north and south hold apron and acquire
security equipment (AIR 31); and
RE50LVEDThere Is hereby appropriated within the Airport Fund the amount of
$7,320,884 reoognizing federal, state and National Guard Bureau grant funds to be used for
said project.
The City Finance Directgor is hereby authorized to place these amounts within the
appropriate amounts.

GRANT AGREEMENT
PART I - OFFER

(Hereinafter referred to as the -Sponsor'
FROM: The State of Maine (acting through the Department of
Transportation, Office of Passenger Transportation, hereinafter
referred to as the "Department')
WHEREAS, the Sponsor has submitted to the Department a Project Pre -application
r Reguest for Aid involving a grant of State funds for a project for the
acquisition, construction, establishment, safety, expansion, improvement or
Protection of the Ban<or AHarris, aimed. Airport (hereinafter called the
"Airport").
WHEREAS, the Department has approved a project based upon this request for
development of the Airport (hereinafter called the 'Project') consisting of
the following described airport development:
Phase 1, Rehabilitate and Narrow Runway 15-33; Rehabilitate Taxiways ^K^ and
^M^; Rehabilitate North and South Hold menace.
NOW THEREFORE, pursuant to and for the purposes of carrying out the provisions
of 6 M.R.S.A. 517.1, 17.9, and 515.1, and in consideration of (a) the
Sponsor's atceptance of this Offer, as hereinafter provides and (b) the
benefits Toc
stores to the public from the accomplishment of the Project and
the operation and maintenance of the Airport, as herein provided.
THIS MAINE DEPARTMENT OF TRANSPORTATION 19 AN AFFIRMATIVE ACTION - EQUAL OPPORTUNITY EMPLOYER
THE DEPARTMENT, MR AND ON BEHALF OF THE STATE OF MAINE, HEREBY OFFERS AND
AGREES to pay, as the State's share of costa incurred in accomplishing the
project, 5% percent of all approved project costs, subject to the following
terms am conditions:
1. The maximum obligation of the State payable under this Offer shall
be: One Nwdxed Sixty-Slx Thmmod Six Hundred Sixty -Six ($166,666.00)

z. Sponsor shall --
a. accomplishrent of the Project within a reasonable time
after acceptance of this Offer, and;
E. Carry out and complete the Project in accordance with the terms
of this Offer, and;
r. Carry out and conplete the Project in accordance with the plane
or sketches and specifications as approved by the Department Or maas they y be
revised or modified with the approval Of the Department, and;
d. Take necessary legal action to revoke any and all existing non -
aeronautical rights of way or ensurdorances across the lending strip and
prevent the issuance of any further such permits or rights of way to cross
said strip, and;
e
Pursuant to 6 N.R.S.A., operate and maintain the Airport and all
facilities
thereon o connected therewith which a necessary for airport
purposes, and not permit any activity thereon which would interfere with its
oee for aeronautical purposes except with the prior written approval of the
pariment, and;
£. Operate the Airport for the use and benefit Of the public on
fair and reasonable termswithout unjust discrimination, and
g. Insofar as is within its power and reasonably possible, the
Sponsor will prevent the use of any land either within or outside the
boundaries of the Airport in any ma r (including the construction, creation,
alteration, or growth of any structure or other object thereon) which would
Bate a hazard to the landing, taking off, or maneuvering of aircraft at the
Airport, or otherwise limit the usefulness of theAirport.
3. The Sponsor certifies that it holds property interests in the are
of laid which are to be developed or used as a part Of or in connection with
the Airport.
4. The Sponsor shall keep an accurate accounting of all costa incurred
n the Project and submit a copy of such accounting to the Department upon its
request for reimbursement of such casts by the Department.
5. This Offer shall expire and the State shall not be obligated to pay
any Of the costa of the Project unless this Offer has been accepted by the
Sponsor within sixty (60( days from the above date of Offer or such longer
time as may be prescribed by the Department in writing.
6. The Sponsor agrees to conscientiously perform preventative
maintenancen the completed projectandto make no application for State
funds for repair or replacement of the Project as a result of failure to
perform such maintenance.

The Sponsor's acceptance of this Offer shall be evidenced by execution of this
instrument by the Sponsor, as hereinafter provided and said Offer and
acceptance shall comprise a Great Agreement constituting the obligations and
rights of the State and the Sponsor with respect to the accomplishment of the
Project and the operation and maintenance of the Airport. Such Grant
agreement shall become effective upon the Spon acceptance of this Offer
and shall rmain in full force and effect throughout the useful life of the
facilities developed antler the Project but in any event not to exceed ten (10)
years from the date of said acceptance.

incorporated materials referred to in the foregoing Offer and does hereby accept said Offer and by such
acceptance agrees too all of the terms and conditions thereof.
