NOW THEREFORE, pursuant to and for the purpose of carrying out the provisions of the Title 49, United States Code, herein called Title 49 U.S. C., and in consideration of (a) the Sponsor's adoption and ratification of the representations and assurances contained i said Project Application and its acceptance of this Offer as hereinafter provided, and (b) the benefits to accrue to the United States and the public from the accomplishment of the Project and compliance with the assurances and conditions as herein provided, TRE FEOERAf, AVIATION ADXINZSTRATION, FOR AND ON BEHALF OF THE UNITED STATES, HEREBY OFFERS AND AOREES to pay, as the United States sham of the allowable coats incurred in accomplishing the Project, 90 percent of such costs. The Offer is made on and subject to the following terms and conditions: CORQltions 1. The mossimum obligation of the United states payable under this offer shall be $2,198,032.00For the purposes of any future grant amendments which may increase the foregoing miximon obligation of the United states under the provisions of Section 40308(6) of the Title 49 U.S.C., the following amonnte are being specified for this purpose. $ 0.00 for planning $2,198,932.00 for airport development or noise program implementation. 2. The allowable coats of the project shall net include any costa determined by the FAA to be ineligible for consideration as to allowability under Title 49 U.S.C. 3. Payment of the United states share of the allowable project roots will be made pursuant to and in accordance with the provisions of such regulations and procedures as the Secretary shall prescribe. Final determination of the United States share will be based upon the final audit if the total aunt of allowable project costa and settlement will be made for any upward or downward adjustments to the Federal share of costs. 4. The sponsor shall carry out and complete the Project without undue delays and in accordance with the terms hereof, and such regulations a:d procedures as the Secretary shall prescribe, and agrees to comply with the assurances which were made part of the project application. S. The FAA reserves the right to amend or withdraw thin offer at any time prier to its acceptance by the sponsor. 6. This offer shall expire and the United States shall not be obligated to pay any part of the costa of the project unless this offer has been accepted by the sponsor on or before Snly 12, 2002, or Such subsequent date an may be prescribed in writing by the FAA. ]. The sponsor shall take all steps, including litigation if necessary, to recover Federal funds spent fraudulently, wastefully, or in violation of Federal antitrust statutes, or misused in any other mann any project upon which Federal funds have been expanded. For the purposes of this grant agreement, the term 'Federal funds- means funds however used r disbursed by the sponsor that were riginally paid Interest to this or any other Federal grant agreement. It shall obtain the approval of the Secretary as to any determination of the amount of the Federal share of such funds. It shall return the recovered Federal share, including funds recovered by settlement, order or judgment, t0 the Secretary. It shall furnish to the Secretary, upon request, all documents and records pertaining to the determination of the amount of the Federal share or to any settlement, litigation, negotiation, or other efforts taken to recover such funds. All settlements or other final positions of the sponsor, in ourt or otherwise, involving the recovery of such Federal share shall be approved in advance by the Secretary. a. The United States shall not be responsible or liable for damage to property or injury o persons which may arise frees, or be incident to, compliance with this grant agreement. 9. Buy American Requirement: Unless otherwise approved by the PAA, the sponsor will not acquireor permit any contractor o subcontractor to acquire any steel c manufactured products produced outside the United States to be used for any project foairport development or noise compatibility for which funds are provided wider this grant. Me Sponsor will include in every contract a provision implementing this special condition. 10. The Sponsor agrees to perform the following: 1. FYmieh a construction management program to PAA prior to the Start of construction which Shall detail the measures and procedures to be used to comply with the quality control provisions of the construction contract, including but met limited to, all quality control provision and required by the federal Specifications. The program shall include as a minimum: a. Me news of the person representing the Furnace who has overall responsibility for contract administration for the project and the authority to take necessary actions to comply with the contract. I. Names of testing laboratories and consulting engineer time with quality control responsibilities on the project, together with a description of the services to be provided. C. Procedures for the testing laboratories to meet the requirement of the Applicable American Society of Testing Material's Standards on laboratory evaluation, referenced in the contract specifications (D 3666, C1099). d. Qualifications of engineering supervision and construction inspection personnel. eA listing of all teats required by the contract specifications, including the type and frequency of teats to be taken, the method of sampling, the applicable test standards, and the acceptance criteria or tolerances permitted for each type of teat. f. Procedures for ensuring that the teats are taken in accordance with the program, that they are documented daily, that the proper corrective actions, where necessary, are undertaken. 2. Submit at completion of the project, a final teat and quality control report documenting the results of all testa performed, highlighting those reach that failed of did PMP® 5100.3] (10.89) Page 3 not meet the applicable test standard. Such reduction shall be at the discretion of the PAA sod will be based on the type of types of required testa not performed or not documented end will be comengurate with the proportion of applicable pavement with respect to the total pavement constructed under the grant agreement. 4. The PAA, at its discretion, reserves the right to conduct independent testa and to reduce grant payments accordingly if suchrne independent testa detemithat Sponsor test results are inaccurate. 11. An effective pavement maintenance managment programdu ra that details the procereS r to be followed to a ma e that proper pavement maintenance, both preventive and repair, is performed. An airport sponsor may use any form of inspection program it deems appopriate. The program moat, as a minimum, include the following: 1. Pavement Inventory. The following must be depicted in an appropriate form and level of detail: a. Location of all runways, taxiways and apron$; b. Discussions; C. Tpe of pavement; d. Year of construction or most recent major rehabilitation. For compliance with the Airport Improvement Program aSSUranCeS, pavements that have been nstructed, reconstructed, or repaired with federal financial assistance shall be so depicted. 2. Inspection Schedule. a. Detailed Inspection. A detailed inspection mot be performed at least once a year. If a history of recorded pavement deterioration is available, i.. Pavement Condition Index (PCI) survey a set forth in Advisory Circular 150/5380 -fie guidelines and Procedures for Maintenance of Airport Pavements, the frequency of inspections may be extended to three years. b. Drive-by Inspection. A drive-by inspection moat be performed a minimum of once per month to detect unexpected changes in the pavement Condition. 3. Record Keeping. Complete information on the findings of all detailed inspections and on the maintenance performed Mgt be recorded and kept on file for a minimum of five Years. The types of distress, their locations, and remedial action, scheduled or performed, mot be documented. The minimum information to be recorded in listed below. a. inspection date; b. location; distress types; L. maintenance scheduled or performed. Por drive-by inspections, the date of inspection and any maintenance performed must be recorded. 4. Inforeation Retrieval. an airport sponsor may use any form of record keeping it m deems appropriate, so long as the iv£oration and records produced by the pavement survey an be retrieved to provide a report to the PAA as may be required. Refer to Advisory Circular 150/5360-6, Guidelines and procedures for Maintenance of Airport Pavements, for specific guidelines and procedures for maintaining airport pavements and establishing an effective maintenance program. Specific types of distress, their probable causes, inspection guidelines end recommended methods of repair are presented. 12. It is understood and agreed that no reimbursement on engineering costs until a fully executed contract is received and approved by PAA. The project also includes the rehabilitation of the north and sough hold aprons along Tandway'A' which are not AIP eligible and are to be funded by the Maine Air National Guard. RehaNNa0on of RAN 1533 will include narowirg the rurnaay width from 300 feet to the standard 200 feet, repairing deteriorated! Tavxaya'K' and 'M' and the north and south hold apron's rehabilitation will consist of milling S° of the emitting deteriorated PCC, crack and seating the milled PCC slabs, installation of a SAMI and a 4- P401 pavement overly. The north hold apron will incorporate a P-501 PCC slab for aircraft warm ups. Tindways'K and Wand the north and south hold apron's shoulder pavement will consist of 3- of P401 and 0' of P -20g. The RAN 33 end safety area length beyond the runway will be re -graded and paved with Y of 13-401 and T dP-20g. The regrading is required to remove ground interference to the RNJ 15 locatizer. Electrical upgrades in coordination with the phased construction and narrowing of the RAI will be incarcerated in to the project. Electrical upgrades include upgrade of the anco 's electrical vault to bring it to current electrical standards, a new emergency generator, new circuit cables and lighting for the runway, Taxbvays'A%-K','L','INT and 'N' and the north and south hold aprons. Incorporated into the project will be modifications to the FAA's runway 15 and 33 PAPI's, reconstruction of the runway 33 MALSR, relocation of the RW 15 localizer and relocation and replacement of the RW 33localizer ENGINEERING FEES: The grant includes engineering hes not covered under the previous grant application, AIP No. 3-234W0 0.
