As part of the ANation and Transportation Security A the Federal Transportation Secudty
Administration (TSA) has been directed to post federal law enforcement officers at all weaning points at
airports. The TSA has already begun the process of hiring Security Directors to oversee security at
airports, but it will take them a few monttss to hire and twin enough law enforcement officers to insure
each screening point is property manned. In the Interim, the TSA Is attempting to contract with local law
enforcement agencies to protide the mandated security levels at Bte airports until the TS.A is suitably
staffed. This order will provide the opportunity for the City of Bangor to obtain reimbursement from the
federal government for law enforcement seMce provided at the airport.

As you know, fm the lastf months the National Guard has been deployed at airports to
assist with security measures, effortswwdth awthempresmcemenowmdeway,mdbytheend
of May the Notional Guard will be gone. The TSA would like to have an agreement with the City of
Bangor in place and officers assigned to the screening points by May 10" so that security is not
jeopardimd
We currently have three full time effects assigned to the airport supplemented with overtime
shi0a in order to provide one office on the premises seven days a week from 5:00AM mail I0:30PM.
To meet the needs of the TSA, I would need an additional officer six days a week from 5:00AM to
6:OOPM. If this agreement is approved, I will most likely transfer ora additional officerto the airport,
and fill the remaining shifts with overtime details. The TSA intends to reimburse the City for the cast
ofpmviding this service. It is my mdmstaMing that this agreement will allow us to pass most ofom
law enforcement costs onto the TSA, instead ofBIA.
I assume this agreement will require Council approval. Given that they would like to have
officers is place by May W, I would appreciate it if you would get this on the appropriate committee
agenda as soon as possible. I have a copy of the agreement that I will distribute at the committee
meeting.

MEMORANDUM OF AGREEMENT (MOA) BETWEEN
U.S. GOVERNMENT

City of Bangor, Maine
ARTICLE 1. PARTIES
The parties to [Iris Mersamumm of Agreement (MOA), motherwise refired to Irrem as
"Agreement," aro the Government ofthe United States ofAmerica (Government) and Me
City Of Bangor.
ARTICLE 2 SCOPE
a. Forporo
TM pspose of this Agreement is to provide financial relief in the form of full or panel
reimbursement to the City of Bangor, for its was in fulfilling Security Directive SD
1542-M-01. The Security Directive takes precedence over anything in this MOA This
MOA neither gaa maces nor forbids reimbursement through other progrmns that may be
available as long as the United States Government does not fund the same expenses
through differeat programs or agencies.
b. Contributions of the Parties:
(I) The Government agrees to reimburse or partially reimburse the cost of the law
enforcement of3cers supplied by the SHA Reimbursement in: subject to the availability
ofappropnated fnu ivg im this purpose. Such funding shall cover services provided
from inception of this agreement until such tone as the TSA assumes responsibility for
said services m accordance with Article 4, Effective Date and Tam or such time that this
MOA is terminated in aaordaoce with Article 9.
(2) The City olBangor is responsible for providing law enforcement officers m
accordance with SD 1542-02-01 regardless of the status of this agreement Currently,
TSA plans to termmate this agreement when it has its own federal law enforcement
persomnl at the airport's Passenger Screening Locations.
ARTICLE3. DEFIMTIONS
a The "Supporting Host Agency" (SIN) is the organizational entity authorized to order
into this agreement. In most cases this will be the airport or its goveming body.

ARTICLE 4. EFFECTIVE DATE AND TERM
The effxtive dare ant Term oftMs Agreement is May 10, 2002 and shall continue in
effect untilDecember 1, 2003 or until earlierterminated by the parties taprovldN herein.
The TSA may choose to extend the room ofthis agreement, at its sole discretion, for up to
an addncnall Ndays beyoM the above stated completion date. The termination of this
agreement by either party, does not, in Eself, relieve the amount from compliance with my
£Neral law, rule, regulation, or dvective in effect.

ARTICLES. CHANGES, MODIFICATIONS
Changes and/or modifications to this Agreement shall be in writing and sighed by a

modification shall cite the subject Agreement, and shall state the enact mature ofthe
modification. No oral statement by airy person shall be interpreted as modifying or
otherwise affecting the tams ofthis Agreement.
ARTICLE 9. TERMINATION
a. In initiation to my oder termination rights provided by this MOA, either party may
terminate this MOA m anytime prior to its expiration data, with or without cause, ant

ARTICLE 10. ORDER OF PRECEDENCE
In the event of my inconsistency between the terms of the Agreement or any Use,
regulxNom or Security Directive, the inconsistency shall be resolved by grvrn8 preference

(b) TIds MOA, then
(c) The Appendices to this MOA
ARTICLE Il.
The parties agree that they shall take appropriate measures to protect proprietary,
privileged, or otherwise confidential information that may come into their possession as a
