HomeMy WebLinkAbout2002-04-08 02-171 ORDERItem No. 02-171 Date: April 8, 2002 Item/Subject ORDER, Authorizing Agreement with the University of Maine -- Museum of Art Responsible Department: Legal Commentary: On October 23, 200, by Council Order 00-399, as amended, the City Council authorized a challenge grant to the University of Maine for the purpose of locating the Maine Museum of Art In Ommown Bangor. The City Council agreed to give the Un"versity of Maine $9D0,000 if the University minetl a minimum of $900,000 and met certain other requirements regarding the reloration of the Museum of Art to downtown Bangor. The University has raised $900,000, but was not able to relocate the Museum of Art as early as originally planned. This Order will authorize an Agreement to give 0re University $900,000 provided it meets certain requirements regarding the relocation and operation of the Museum of Art. The Agreement is consistent with the provlsiore of Council Order 00-399, as amended, with the exception of dates. ORDER, Authorizing Agreement with the University of Maine --- Museum of Art By fix Oily cs&vkv of ote O'ty of Fargo: ORDERED, WHEREAS, the CRy has worked with the University toward locating the University's Museum of Art in Downtown Bangor; and WHEREAS, the presence of a quality Art Museum in Downtown Bangor is estimated to attract 20,000 visitors annually and will assist the City in meeting its long-term goals for downtown; and WHEREAS, such a facility will also serve to strengthen the ties between the University and the City; and WHEREAS, the City recognizes that its financial support is necessary to accomplish this goal; and WHEREAS, by Council Order 00-399, as amended, the City Council authorized a challenge grant to the University of Maine for the purpose of locating the Maine Museum of Art/Visual Arts Center in Downtown Bangor; and WHEREAS, the University has raised $400,000 for the purpose of locating its Art Museum in Downtown Bangor, though not within the time frame provided in Council Order 00-399, as amended. NOW, THEREFORE, BE )T ORDERED THAT the City Manager is authorized to execute an Agreement with the University of Maine. Said Agreement Is attached hereto. State of Maine WHEREAS, the City has worked with the University toward lreming the Universtys Museum of Art th Downtown Bangor, and WHEREAS, the City recognizes that its finaacial support is necessary to accomplish flus goal; and WHEREAS, the presence of quality Art Museum m Downtown Bangor is esmand d m attrect 20,000 visitors =natty and will easier the City in meeting its long -teem goals for downtown; and WHEREAS, such a facility will also serve to strengthen the ties between the University and the City; and WHEREAS, the University has raised 5400,000 for the purpose oflocetiag its Art Musemn in Dowmowm Bangor. NOW, THEREFORE, IN CONSIDERATION of the mutual premises and covenants containxi in Us Agreement. the City end the University agree as follows: 1. On or before July 1, 2001, the University shall complete a lease agreement for the necessary space for the Museum to be located in Nouombega Hall, Harlow Street, Bangor, Maine. 2. The University shall arrange for an initial lease from the Conn Foundafioq owner of Norumbege Hall, for the Museum of Art for a nommum of not less than five (5) years with two (2) five (5) year provisions for renewal, commencing not later than July 1, 2001. 3. In conjunction with the Museum of Art; me University shall operate in downtown Bangor a Visual Arts Carter which shall offer chuees, workshops, and other events serving a wide range of individuals including children, young adults, senior citizens, and other adult populations. S That the University agrees that the Museum of Art and Visual Arts Center shall he open m tic public sixty hour a week. o2-ln 6. That the University agrees to reloome and house the Museum of Arc's permanent collection to Nommbega Hall, the permanent collection being comprised of approximately 4,500 objects with a fair market value of approximately $6,000,000. 7. That the University provide all necessary formes for the facility, a an expense of epproximately$75,000, and neimain an armual operating budget for the f ility of not less than $200,000 and employ a minimum of four and one-half(4 %) full-time anployees and fifteen (15) work-study students from the greeter Bangor community. S. 13mt upon occupancy, of the Museum of Art and Visual Arcs Center, the University shall be responsible for all costs associated with its operation including staff costs, waster, sewer, and electrical utilities, fee and casualty insurance, security and all other related costs. 9. That the University shall make availabletm, annual fall tuition scholarships forresidem Bangor students for aperiod clean less than tan years, such scholarships to be awarded by the Tmstres ofthe Sophia Kirstein Student lam Fund. 10. Thm the University shall undertake its best efforts to insure that the Museum is opened an or before December 31, 2002. Il. That the University shall agree to maintain and operate the University Museum of Art and Visual Arts Center in downtown Bangor for a miNmum of 10 years from the data it opens. 12. That the City will gift to the University the sum ofS400,000 to be paid out in the following mercer aRerthe University expends $300,000 an the costs of construction the University shall submit invoices for combustion work completed to the City's Finance Director and the City shall pay the invoices until such time as the City shell have expanded $400,000.
