Item/Subject: Order, Authorizing City Engineer to Begin the Process of Discontinuance of a Portion of
Railroad Street

Commentary: This Order will begin the process to discontinue a portion of Railroad Street. The portion
of Railroad Street to be discontinued is located on the northerly side of Railroad Street and immediately
west of the railroad tracks. The discontinued portion includes approximately 5,890+ square feet of land
as shown in Exhibit A. While this portion of the street has been accepted as a public way, it is no longer
used as a right-of-way and it is not used by the general public or needed for public purposes. The City
will retain a 20 -foot sewer easement to operate and maintain an existing sanitary sewer main located on
the property.
Under 23 M.R.S.A. § 3032, the City would discontinue the portion of Railroad street as depicted in Exhibit
A. With the discontinuance completed, the City of Bangor will retain sufficient right of way to use and
maintain Railroad Street

(TITLE.) Order, Authorizing the City Engineer to Begin the Process of Discontinuance of a
Portion of Railroad Street,
WHEREAS, The portion of Railroad Street to be discontinued is located on the northerly side of
Railroad Street and along the west side of the railroad tracks and was accepted by
the City in 1894; and
WHEREAS, The discontinued portion of Railroad Stmt includes a 20` wide sanitary sewer
easement on the parcel as shown in Exhibit A; and
WHEREAS, said portion of Railroad Street is no longer necessary to serve the public as a
right-of-way;
WHEREAS, the City will discontinue the portion of right-of-way along Railroad Street as shown
in Exhibit A; and
NOW THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR
THAT
the City Engineer is hereby authorized and directed to begin the process of
discontinuing the Worm of Railroad Street as shown in Exhibit A in accordance
with the provisions of 23 M.R.S.A. § 3026 and to submit a written report to the City
Council for further action. A sanitary sewer easement shall be retained for public
use and maintenance on the discontinued parcel as shown in Exhibit A.
