COUNCIL ACTION Item No. 17-134 Date: April 10, 2017 Item/Subject: Order, Accepting the City Engineer's Report to Discontinue a Portion of Railroad Street Responsible Department: Engineering Commentary: Under 23 M.R.S.A. § 3026-A, before discontinuing a road, the City Council must provide notice to abutting property owners. Notice was provided and the City Engineer provided a public hearing on April 4, 2017 at 2:30 p.m., second floor Engineering Conference Room, City Hall, 73 Harlow Street, Bangor. This Order would accept the City Engineer's Report for the discontinuance of a portion of Railroad Street. The portion of the road in question is not used as a right-of-way, nor needed for public purposes. John M. Theriault to begin the process to discontinue a portion of Railroad Street in its entirety and in accordance with 23 M.R.S.A. §3026-A, the City Engineer reports: That of his intention to discontinue said portion of Railroad Street, the City Engineer gave written notice to the sole abuxer: Bangor Savings Bank Attn: Accounts Payable P.O. Box 930 Bangor, ME 04402 Said notice with a detailed plan was also posted on the public bulletin board a<< Hall and on two utility poles in the vicinity of the proposed discontinuance. In accordance with the notification given, the City © conducted a public hearing on April 4, 2017 at 230p.m. relative to the intention of the Munpal Offcers of the City of Bangor to discontinue a portion of Railroad Street. I. There is no longer any public interest or, need to retain the portion of Railroad Street as a pu8ic right of way. 2The portion of Railroad Street to be discontinued is located on the northerly side of Railroad Street and along the west side of the railroad tracks and was accepted by the City in 1894. I The portion of Railroad Street includes a 20 wide sanitary sewer easement on the parcel as shown on Exhibit A, which the City shall retain. 4. In accordance with 23 M.R.S.A. § 3026-A, abutting property owners are entitled to $0.00 damages. It is recommended that the portion of Railroad Street be discontinued and vacated in its entirety, and removed from the Official City Map, with the retention of a public easement for public utilities.
