Penview Associates has submitted a proposal to the City for the development of40 residential
condominiums on a City owned development site located on me north side of Railroad Street in the City's
riverfrom development project This Order would loot Penview Associates exclusive status as developer
of the site unfil October 27,2003. Until then the City would deal exclusively with Penview Associates for
development of the site. Cuing this period, Penview, Associates would have o opportunity in submit for
the City Council's consideration a more defined development proposal that would be incorporated into a
development option agreement f me Council's consideration an or before October 27, 2003.

WHEREAS, Penview Associates has proposed b develop residential condominiums on a
CM owned development site located on the north site of Railroad Sheet in the Bangor
Riverpaik on the Penobscot Master Plan; and
WHEREAS, the CM has granted "tentative developer" states W potential developers on
various City owned development sites in the past, thereby pnividing the developer and City
staff time to prepare a development option agreement for the City Council's consideration,
during which time the City agrees W deal exdusiveN with the designated tentative developer
for the purpose for which tentative developer staWs was granted;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CM OF BANGOR
THAT, Penvlew Associates is herebydesignated the tentative developer of a City owned
development site located on the north side of Railroad Street, the boundaries of which will be
defined in a development option agreement; that such designation is in effect until October 27,
2003; that City staff and FairviewAswdates negotiate a development option agreement for the
City Courage caolberadan on or before October 27, 2003 for the development of 40 readential
condominiums on the site; that Pemiev Associates shall have until October 27, 2003 W prepare
and submit In writing to -the City a specific proposal for development of residential
condominiums on the site; and that during the period of designation the City agrees to deal
exduswely with Penview Assod" for the purpose for which tentative developer status was
granted. The proposal submitted for the City's consideration shall be sulfident in derail to
oudire the general scope of development and convey wf dent Information for the City to
calamine the level of investment proposetl and character of the work to be performed.
Preliminary plans submitted for.the Coundl's consideration as part of the developer option
agreement are to include a she plan showing the proposed layout of the building and other site
improvanents;.a preliminary Boar plan showing propereal general room layouts and -overall -
Boor area for each floor, and a wirable croa-section or elevation of the building showing the
relationship of fioors W surrounding grades and malar als W be used for exterior treatment.
