Commentary: The grants from the FAA and Maine Department of Transportation for the
Parking Study and Blast Assessment Study (AIP 34) at Bangor International Airport have been
accepted. The funds need to be appropriated. The total cost of the proJect will be
approximately $88,000 with 90% covered by the FAA, 5% from the State and the balance from
Me Airport operating budget. This resolve will appropriate Mese funds.

WHEREAS, The City accepted an Airport Improvement Project gram available through the
Federal Aviation Administration to study the long-term needs of parking at Bargor Internabonal
Airport and perform a blast analysis at the Airport; and
WHEREAS, Federal funds cover 90% of the Cost of the project, the State of Maine rovers 5%
and the balance of 5% is covered by the Airport operating budgert;
NOW, THEREFORE, BE IT RESOLVED BY THE CFIY COUNCIL OF THE CFIY OF BANGOR THAT
the amounts of $79,200 from a United States Department of Transportation, Federal Aviation
Administration grant and $4,400 from a State of Maine, Department of Transportation grant are
hereby appropriated for the purpose of undertaking a Parking Study and Blast Assessment
Study (AIP 34) at Bangor International Airport.
The City Finance Director is hereby authored to place these amounts within the appropriate
Airport Department accounts.

WHEREAS, the SPDPBOR has submitted to the D¢PART6Rt aProject Po -application

'AMORT -1.
WHEREAS, the MISSU mage has approved a project based upon this request for
development Of the AIRPORT (hereinafter called the `PROJECT") consisting of

terms and conditions:
1. The maximum obligation of the State payable under this Offer shall
be: Fear Thensand Four eundre3 (64.400.eo) Dollars and o0/100.
2. SPONSOR shall --

after acceptance of this Offer, and: -
b. Carry out and complete the PROSSCL in accordance with the terms
of this offer, and;
0. Carry out and Complete the PROdeCS in accordance with the plana
or sketches and Specifications as approved by the pRPRRTavNT Or as they may be
revised or modified with the approval Of one DEHIJOSIES, and;
d. Take nereseary legal action to revoke any and all existing non-
autical rights of way O encumbrances across the landing strip and
prevent the ie of Say further such Permits or rights Of way to cross
said strip, and;
a. Pursuant to 6 H.R.S.A., Operate and meintain the AIRPORT and all
facilities tbecom or connected therewith which are necessary for airport
purposes, and not permit any activity thetaon which would interfere with its
e for aeronautical Purposes except with the prior written approval of the

f. Operate the AWORT for the use and benefit Of the public on
fair and reasonable teras without unjust diacrimistion, and
gs Insofar as is within its power and reasonably Possible, the
Sponsor will prevent the use of any land either within or outside the
boundaries 0£ the Mance? in any manner )including the construction, creation,
alteration, o meth of Say structure or other object thereon) which would
create a hazard to the landing, taking off, oring of aircraft at the
FERPJRT, or Otherwise limit the usefulness Of the AIRPORT.
3. The SPONSOR certifies that it holds Property interests in thea as
of land which are to be developed or used as a part of or in connection with
the AIRPORT.
6. The SPONSOR Shall keep an accurate accounting of all costs

n the PROJECT and submit a copy of Such accounting to the DePART1OIM'upon its
regnet for reimbursement of such Costs by the DBPARi2ma1'.
S. This Offer Shall expire and the State shall not be obligated to pay
any of the Costs of the PROSecT unless this Offer has been accepted by the
SPONSOR within Sixty (60) days from the above date of Offer Or Such longer
tee as may be prescribed by the DPPAR•MSNL in writing.
6. The Sponsor agrees to conscientiously parform preventative
intenavice on the completed PROSecTand to make no application for State
funds for repair or replacement Of the PROSECT as a result offailure in

general liability Or other coverage affording equal Or greater protection AS

omissions that provides minimum liability coverage of $110001000 per claim and
Annual Aggregate. This pOlicy shall cover negligent acts, errorsemissions

The Sponsor's acceptance of this Offer shall be evidenced by execution of this
natrvment by the Sponsor, as hereinafter provided and said Offer and
acceptance shall comprise a Grant Agreement constituting the obligations and
rights of the State and the Sponsor with respect to the accomplishment of the
Project and the ocera[iOn and maintenance of the Airport. Such grant
Agreencnt eha11 isave effective upon the Sponsor's acceptance of this Offer
and shall remain in full force and effect throughout the useful life Of the
facilities developed under the Project but in any event not to exceed ten (10)
years from the date of Said acceptance.
