Ordinance, Amending the Code of the City of Bangor by Deleting Chapter 81, Building Code, and Replacing It with New Chapter 81, Building Code. The Code or the Dry of Bangor is hereby amended by deleting and repealing Chapter 81, Building Code. Section 2 The Code of the City of Bangor is hereby amended by adding thereto a new Chapter, to replace Chapter 81 hereinabove repealed, W be Chapter 81, Building Code, as fallow is §81-1. Adopted of Code. In accordance with 30-A M.R.S.A. § 3003, as the same may be amended from time W time, the International Building Code 2003, published by the International Code Council, Inc., is hereby adopted and incorporated by reference herein as the minimum standard for the construction, alteration, addition, repair, removal, demolition, use, location, occupancy, and maintenance of all buildings and structures and their seance equipment, both existing and proposed, located within the Ory of Bangar. § 81-2. Amendments. / Said Building Code is adopted in its published form as if fully set Porth herein, except as follows: A. Section 101.1 is deleted and replaced with the following: 101.1 Title: These regulations shall be known as the "Building Cade of the City of Bangor," hereinafter referred W as "this code." B. Section 103.1 and 103.2 are deleted and replaced with the following: 103.1 Code official: Further references in this code to the "code official" shall be interpreted W - mean the Chief Code Enforcement Officer of the City of Bangor. C. Section 105.1.1 and 105.1.2 are deleted and replacetl with the following: 105.1 By whom appliatlon is made: Application for a permit shall be made by the owner or lessee of the building or structure, or agent or either, or by the licensed engineer or architect 03-220 employed in connection with the proposed work. The full name and address of the owner or lessee, the applicant and of the responsible officers, if the owner or lessee Is a corporate body, shall be stated in the application. 0. Section 108.2 is deleted and replaced with the following: 108.2 Fee schedule: Foes shall be paid to the City of Bangor In accordance with the schedule set forth in Chapter 109, Fees, Article I, Code Enforcement permits, of the Code of the City of Bangor. E. Section 113.4 is deleted and replaced with the following 113.4 Violation penalties: Penalties for violations of this code shall be imposed in accordance with 30-A M.R.S.A. 4 4452, as the same may be amended from time W time. Each day a violation shall be permitted to exist after notification by the Chief Code Enforcement Officer shall constitute a separate offense. F. Section 114.3 is deleted and replaced with the fallowing: 114.3 Unlawful continuance: Any person who shall continue any work In or about the structure after having been served with a stop -work order, except such work as he or she is directed to perform to remove a violation or unsafe conditions, shall be guilty of a violation of this code. G. Section 115.1 is deleted and replaced with the following: 115.1 vacating structures: In addition to the enumerated circumstances in the International Propefty, Maintenance Code 2000, or subsequent amendments thereto, the Code Enforcement Officer may order an immediate vacating of any part of, or all of, a structure which loses its source of heat, cooling, hot water, water supply or sewer service or has malfunctioning electrical service or has been substantially damaged due to fire or natural disaster. When, in the opinion of the code offidal, there is actual and immediate danger of failure or collapse of a structure which would endanger life or when any structure has fallen and life is endangered by the occupancy of the structure or when there is actual or potential danger to the building occupants or those in the proximity of any structure because of explosives, explosive fumes or vapors or the presence of toxic fumes, gases or materials or use of defective equipment, the code official is hereby authorized and empowered to order and require the occupants to vacate the premises forthwith. The code official shall cause to be posted at the main entrance to such structure a notice reading as follows: 'This structure is unsafe and its use or occupant,• has been prohibited by the code official." It shall be unlawful for any person to enter such structure except far the purpose of securing the structure, making the required repairs, removing the hazardous card! ton or demolishing the structure. H. Section 112.2 is deleted ant replaced with the following: 112.2 Application for appeal: The owner of a building or structure or any other person may appeal W the Boats of Appeals, as established by Chapter 23, Article I of the Code of the City of Bangor, from a decision of the code official refusing to grant a modification to the provisions of this code covering the manner of construction or materials to be used in the erection, alteration or repair of a building or structure. Such appeal shall be commencetl by following Ne procedures set forth by Chapter 23, Article I of the Cade of the City of Bangor. I. The fallowing sectors are deleted in their entirety: 112.1 and 112.3. 03-220 3. Section 312.1 is deleted and replaced with the following 312.1 General: Buildings and structures of an accessory character and miscellaneous structures not classified in any specific use group shall be construct, equipped and maintained to conform W the requirements of this code commensurate with the fire and life hazard inddental to their occupancy. Use Group U shall include fences, tanks, cooling towers, retaining walls and buildings such as private garages, carports, shade and agricultural buildings.
