Commentary:
Ttle 30-A, § 2526(5)(A)(3) of the Maine Revised Statutes requires that a City Assessor be
appointed by the Council for a term not to exceed five years. The purpose of this Order is to
reappoint Benjamin F. Birch, Jr. to the position of City Assessor. Mr. Birch was last appointed in
February 1997, which appointment technically expired in February 2002, although the statute also
required the appointed assessor to serve until his replacement is appointed. This appointment will
allow Mr. Birch to serve as the City Assessor in accordance with his contract until February 2007.
