The attached Order authorizes execution of a routine agreement with MDOT, which Involves special
provi9om for moving construction materials and equipment on Qty Streets In conjunction with the upcoming
195/Kenduskeag Stream Deck Rehabilitation project which will be constructed] this spring/early summer. The
primary provisions of the Agreement are twofold: 1) the City to grant permits to move equipment which
exceeds legal limits on City Street (which is routinely done) and 2) the Contractor may be required to post
a bond of up to $9,000 per traveled mile of city streets to cover possible damage.
We have executed similar agreements on a number of previous MDOT projects. Execution of the
Agreement is recommended. Acopy is attached.

The undersigned Municipal Officers of the City of BANGOR agree that a permit will be
issued to the Contractor for the purpose of hauling loads in excess of the limits specified
in Title 29, M.RS.A. on Municipal roads as described in the "Construction Area" and that
single move permits will be issued for moving Contractor's construction equipment used
on the project which exceeds the legal limits (backhoes, bulldozers, etc.) to sources of
construction materials over municipal ways reasonably within the area of the project.
In the event that it is necessary to transport gravel, borrow or other construction material
in legally registered vehicles carrying legal loads over municipal ways, a. Contractor's
Bond of not more than Nine Thousand Dollars ($9,000.00) per kilometer of traveled
length may be required by the municipality; the exact amount of said bond to be
determined prior to use of any municipal way.
The maximum speed limit for trucks on any municipal way will be forty (40) Inn per hour
unless a higher legal limit is specifically agreed upon, in writing, by the Municipal
officers.

Title 29A MR.S.A., Subsectlon 2383. Overlimitmovemempermim
1. Overlimit movement permits issued by gone. The Secretary of Seem, acting under
guidelines and advice of the Commissioner of Transportation, may grant permits m move
orvdivisible objects having a length width, height or weight greater Nan specified in this
Title over a way or bridge maintained by Ne Department of Transportation.
2, Permit Fm. The Secretary of Sera, with Ne advice of the Commissioner of Transportation,
may set the fee for Nese permits, at not less Nan 83, nor more Nen $15, based on weight,
height, length and width.
3. County and municipal permi s. A permit maybe granted, fora reasonable fee, by county
commissioners or municipal officers for travel over a way or bridge maintained by that
cnty or municipality.
0. Permits for weight. Avehicle granted a permit for excess weight must from be registered for
the maximum gross vehicle weight allowed for that vehme.
5. Special mobile equipment no Secretary of State may grant a permit, for no more'Nan one
year, to move pneumario-me equipment under its own power, including Class A and Class B
special mobile equipment, inver ways and bridges maintained by the Department of
Transformation. The fee for that permit is $15 for each 36day period. _
6. Scope of permit: A permit is limited to the particular vehicle or object to be moved and
particular ways and bridges.
9. Construction permits. A permit for a sated period of time may be issued for loads and
equipment employed on public way construction projects, United States Government
projects or construction of private ways, when within construction areas established by the
Deperlment of Transportation. The Permit:
A. Must be procured from the municipal officers for a constructem men within that
municipality,
B. May require Ne Contractor to be responsible for damage to ways used in Ne
construction areas and me provide for:
(1) Withholding bythe agency contraction the work of final payment under contract;
or
(2) The furnishing of abond by be Contractor to guarantee suitable repair or
payment damages.
C. May be granted by the Department of Transportation or by the sate engineer in charge
of the concoction Wmrom; and
D. For construction areas, carries no fee and does net come within the scope of this
section. - -
S. Goss vehicle weight permits. The following may grant permits to operate a vehicle having
a gross vehicle weight exceeding Ne prescribed limit:

limits; and

9. Pilot vehicles and athe police escorts.Pilot vehicles required by a permit most be equipped
with warning lights and signs as required by the Secretary of State with the advice of the
Department of Transportation.

The Semmzry of State shall requhe a Sate Police avoid for a single vehicle or a
combination of vehicles of 125 feet or more in length or 16 feet or more in width. The
Secretary of State, with the advice of the Commissioner of Transportation, may require
vehicles of lasso- dimensions to be escorted by the State Police.
The Bureau of Store Police shall establish a fee for Stam Police escorts.
All fees collected must be used m defray the cost of services provided.
With the advice of the Commissioner of Transportation and the Chief of the State Police, the
S cretmy of State shall establish rules for the operation for the operation of plot vehicles.
10. Taxes paid. A permit for a mobile home may not be granted uniess the applicant provides
reasonable assonance that all property tomes, sewage disposal charges and drain and sewer
statements applicable m the mobile home, including those for the current = year, have
been paid or fhm the mobile home is exempt form those taxes.
