Item/Subject: Order, Authorizing an Amendment to the Employment Agreement With Rebecca
Hupp, Airport Dirxtoq Regarding Residency.

Commemary:
The City Council has recently discussed the anent residency requirement in Rebecca Hupp's
employment agreement with the Council. That provision requires that Ms Hupp relocate to
Bangor on or before January 1, 2004 and natures certain steps the Ory will take to reimburse
certain relocation costs. Ms Hupp has been seeking housing in Bangor since her appointment
as Airport Director. She has been unsuccessful to date due to the Ilmked number of available
propeNes that meet her needs and her inability to make offers on properties without the
contingency Mat she sell her current home in Hermon.
This order will replace the current residency section of her contract with a new section Mat
requires that Ms. Hupp relocate to Bangor only H she ever sells her current residence. It also,
however, offers chain incentives should Ms Hupp choose to relocate on or before January 1,
2005. If she relocates within thls time frame, the City will provide up to three months of
duplicate housing payments and, as in the current contract language, will reimburse her for
closing costs associated with the sale of her home and provide an allowance for moving
expenses. Where the current agreement requires relocation by January 1, 2004, the proposed
amendment would allow an additional year for Rebecca to make use of the proposed reloaton
incentves.
As noted, this will eliminate the current requirement that Ms Hupp relocate to Bangor and
replace it with certain incentives that may assist her in voluntarily making such a move. During
discussions of this issue with the Council, it appears that the City, while supportive of Ms Hupp
reloaton to Bangor, does not believe that it should be mandatory given her posOon with a
non -tax supported enterprise fund and the short distance between Me Airport and her current
residence.

That the employment agreement between the City of Bangor and Airport Director Rebecca Hupp is
hereby amended by replacing Section 7 of that agreement in Its entirely with the following:
Section 7. Residence,
Employee agrees that should she sell her property in Fkmmn, Maine, she will establish residence
within the corporate limits of the City of Bangor and then maintain residence in the City of Bangor for
the term of her employment Should employee relocate to the City of Bangor on or before 3anuary 1,
2005, employee shall be rembursed for the dosing costs associated wit the sale of her residence in
Hermon, for moping expenses to Bangor in an amount not W exceed §10,000, and for the Iffier of her
edstg mortgage in Hermon or her housing payments in Bangor for the period in which duplicate
housing payments are repuired, such pend not W exceed tree (3) months
