Commentary: In November of 1994 the U.S. Department of Health and Human Services transferretl the
the to 60 units of housing at the mmer of Griffin Road and Union Street to the City by Quitclaim Deed.
That deed contained requirements for an outdated process for controlling lead based paint hazards at the
facility. ilwse requirements would have been extremely expensive, and current research indicates could
even be dangerous to the occupants. The negotiated amendment to the deed Includes the standard HUD
approach to interim control of lead based paint hazards. Effectively, we will be required to control lead
based paint hazaMs, Intact lead based paint can remain. This item has been reviewed and approved by
the Business and Economic Development Committee. This Order would authorize the aty Manager W
execute the Deed Amendment.

ORDERED, TRAT
WHEREAS, in November of 1999 the U.S. Department of Health and Human Services
•transferred the title to 60 units of housing at the corner of Griffin Road and Union Street to the
City by Quitclaim Deed; and
WHEREAS, that deed included requirements that the City remove all lead based paint from the
property; and
WHEREAS, since 1999 those requirements are now considered unnecessary, intrusive, and
often dangerous to the occupants; and
WHEREAS, current requirements established by the U.S. Department of Housing and Urban
Development and me Environmental Protection Agency for interim control of lead based paint
hazards are consdered standard and accepted practice; and
WHEREAS, an amendment to the original dead has been successfully negotiated with the U.S.
DeparOnent of Health and Human Services to include the current standard and acceptable
Practices;
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF
BANGOR, THAT the Cry Manager is hereby authorized to execute Amendment No. 1 to the
Quitclaim Deed with the U.S. Department of Health and Human Services.
