Commentary:
The United States Air Porte has a short-term lease with Ne City of Bangor for 0.189 acres. The
lease expires December 31, 2003. The property is currently being used as a location for a temporary .
trailer.
The United Stares Air Farce also leased an abutting parcel of land from the Cry of Bangor
mnsisdng of 15].9] acres. That lease does not expire undan and provides for an option to renew for
another 50 years.
The An Force would like to cynstruct a permanent structure on the 0.189 acre parcel and is
therefore requesting Nat the lease for that parcel be terminated and that the lease for the larger parcel
he amended to add the 0.189 acres.
This Order and a companion Order will terminate the short-term lease and amend the long-term
lease to accomplish this.
The Business and Economic Development Committee recommends approval.

City of Bangor and the United States Air Force to Terminate a Lease — Land Lease

W ItEAS, the City of Bangor leases land to the United States Air Force consisting of
0.189 acres, more or less, by Lease dated Match 1, 2002; and
WHEREAS, the City of Bangor leases an abutting parcel of land to Ne United Seems .
Air Force consisting of 157.97 acres, more or less, by Lease dated
April 25,1986; and
WHEREAS, the United States Air Force desires to add the 0.189 acres With the Lease
consisting of 157.97 acres, subject m the same terms end conditions of
said Lease and terminate the current lease for said 0.189 acres,
Now, tMrefore, by the City Council of the City of Bangor, be it
ORDERED,
THAT the City Manager is hereby named sed] and directed, on behalf of the City of Bangor, to
execute en Agreement to terminate its Lease wild the United States Air Force, dated March 1,
2002, DACW 33-5-02-065. A copy of said Agreement is attached hereto.

AGREEMENT
THIS AGREEMENT, executed this day of 2002, by and
between CITY OF BANGOR, a nowumpal corporation duly organized and exiting under
and by virtue of the laws of the State of Maine, and having its principal offices at 73
Harlow Street, Bangor, Maine (hereinafter sometimes referred to as the Lessor') and
THE UNITED STATES OF AMERICA having aplace of business at 107 Maine
Avenue, Bangor, County of Penobscot, from of Maine (herevufter sometimes referred to
as the Government)
WITNESSETH:
WHEREAS, the Government leases from the City a certain parcel of land
ferment to Indentu a of Lease dated March 1, 2002; and
WHEREAS, said Indenture of Lease provided for a tam through December 7,
2003; and
WHEREAS, the Government lease; from the City another certain parcel of land
Fairmont to an Indenture of lease dated April 25,1986 as the same has been amended
from time to time, said parcel abutting the parcel subject to the Indenture of Lease dated
March 1, 2000; and
WHEREAS, dre parties have agreed to order execute an amendmentm the
Indenture of Lease dated April 25.1986 to include me parcel of land currently subject to
the Indennne of Lease dated March 1, 2002.
NOW, THEREFORE, it is annually agreed that the Indenture of Lease between
the parties dated Much 1, 2002, be and is hereby tenanted.
