Item/Subject: Authorizing Option Agreement for Purchase and Devebpment of Union
Place Development She with David Lawler
Responsible Depamment Business and Economic Development
Commentary: David Lawler has proposed development of the City owned Union Place that would
rehabilitate the four unit residential property at 251-253 Union Street at an estimated cost of $80,000.
Mr. Lawler also proposes to remove his existing video store commercial property at 281 Hammond Street
and construct a new two-story, mixed-use building. The building would have a 5,000 square foot
footprint, with 5,000 square feet of commercial space on the first Floor and We residential dwelling units
on the second floor. It would be located on a portion of the City development site and Mr. tawler's
abuthng land. It would be developed M a cost of not less Nan $600,000. Also proposed is a garage.
The purchase Price of the Dry development she would be $5,000. The With would terminate July 1,
2005 with an option fee of $3,000. The Could could grant a three month extension provision with a
$1,000 per month fee. Option fees would be returned to the developer upon Issuance of a Certificate of
Completion.
For the rehabilitation of 251-253 Union St., prellmill plans would have to be submitted not later than
December 1, 2009 for Business and Economic Development Committee review. Any revisions required by
the City would have to be submitted by December 29, 2004. Final plans would have to be submitted by
January 19, 2005 and approval from the Committee received by March 2, 2005. The rehabilitation would
have to commence by July 1, 2005 and be completed by Decwnber 31, 2005.
For the new construction Proposed, preliminary plans would have be be submitted for Business and
Economic Development Committee review not later than February 9, 2005. Revisions required by the City
would have to be submitted by March 9, 2005. Bnal plans would have to he submitted by April 20, 2005
and approval from the Committee received by May 18, 2005. All reviews and approvals required by the
City`s Land Development Code would have to be secured by lune 21, 2005. Construction would have to
commence by July 1, 2005 and be completed by December 31, 2005. City approvals of all development
plans would he required before conveyance of the property.

WREREAS, David Lawler has submitted a proposal W the City for the redevelopment of a City
owned development she located at the intersection of Hammond and Union
Streets know as Union Place; and
WHEREAS, the redevelopment proposed includes rehabilitation of the four dwelling unit
residential building located at 251-253 Union Street, the removal a the existing
commercial building on the abutting land of David Lawler, the dev"ment of a
garage, and the development of a two-story, mimed -use building with a 5,000
square foot footprint, consisting of 5,000 square feet of commercial spate on the
first floor and five residential dwelling units on the second Poor, to be located on a
porion of the City cleveiorynent site and the abutting land owned by David Lawler;

Bangor, an Option Agreement for Purchase and Development of Union Mate with David Lawler,
providing for the sale and development of the City wined development site coated a< the
comer of Hammond and Union Streets known as Union Plate, under tarns and conditlons
substantially as contained in the Option Agreement for Purchase and DevelDwent of Union
Plate, a copy of which is on file in the office of the City Clerk, and in a final form approved by
Me City Solicitor or Assistant City %Ikimr.
