Responsible Department Police The City of Bangor has historically opposed the extension of pre-dearance W Airports outside of Me United States that are in a position to compete with Bangor International. We have been approached by Halifax International Airport with a request that we drop our opposition W their request, currently pending in Washington, W establish onginating preclearance. Halifax has indicated a willingness W provide guarantees W Bargor that they will not expand originating pre-dearance Into in -transit pre- clearance, given that the later could pose a competitive threat to Bangor Internatiorwl Airport. Halifax has also proposed that both airports explore possible areas of cooperation that would be mutually beneficial. To explore this request, the City Council established a Special Committee m review the City's position. That Committee has now recommended that the City enter into negotiations with Halifax and that the City retain outsMe legal counsel with a background in international law m assist in such areas as the ability of Halifax and Bangor to enter into a binding and enforceable agreement This Omer will authorize negotiations with Halifax and authorize the City Manager to establish a negotiating team to assist in this process. That team will include a representative of the Airport as well as individuals who are familiar with the Issues Involved and the work of the special committee. Wtiereas, the City of Bangor has historically oppossed the extension of preclearance to airports outside of the United States that are in a position W compete for certain types of traffic with Bangor International; and Whereas, we have been approached by Halifax International Airport with a request that we withdraw our opposition W establishing preclearance for traffic originating in Halifax; and Whereas, Halifax has indicated Its willingness W pruvhde binding guarantees that it will not request in - transit pre -clearance, an extension of the pre-deaance program Mat Is most problematic to Bangor lMemabonal's competitive position; and Whereas, Halifax has also proposed that the two airports coaperete in such areas as marketing for air sernce and cargo operations that might result in mutual advantages; and Whereas, the Special Committee on Halifax Pre Clearance has recommended Mat the City enter into negotiations with Halifax on this issues and in light of the offer by Halifax to enter into a legally binding agreement that would preclude in -transit preclearance at Halifax; and Whereas, there are additional benefits that may result from such negotiations including an increase in cooperation between the Bangor region and Atlantic Canada. The City Manager's hereby authorimd to enter into negotations wird Halifax International Airport with the objective of achlin ing a legally billing agreement that would allow Bangor W withdraw its objection W the extension of originating preclearance rights m Halifax and a guarantee that in-branslt preclearance will not be sought by or granted W Halifax IMemational. In addition, won negotiations shall explore order cooperative ventures between these airports that may be in their mutual best interests.
