NOTE: A PUBLIC HEARING IS REQUIRED
This Order refers an Order Ratifying All EXisting City of Bangor Indebtedness to the
August 23, 2004, City Council meeting for a public hearing on whether the Order should
be submitted to the voters on November 2, 2004. This referral complies with the
Procedures contained in the Chapter 18 of the Code of the City of Bangor regarding
initiatives and referendums.

The Intention of this action Is to provide Bangor voters with the opportunity to ratify the city's exiOng
debt, thus qualifying annual bond payments for exemption from the I% limitation should the Palesky
initiative be adopted. For F 05, this amount is slightly in excess of $4.2 Million, p s,

CITY OF BANGOR
(TITLE.) ORDER, Ratifying All Existing City of Bangor Indebtedness
Whereas, on November 2, 2004, the Citizens of the State of Maine will vote whether to
enact a citizens' initiative entitled "An Ad to Impose Limits on Real and
Personal Property Taxes, more commonly known as the Palesky Initiative;
Whereas, if passed, the Palesky Initiative would limit property taxes to 1% of the
assessed value of property;
Whereas, reducing the Oty of Bangor's tax ate to 1% of the assessed value of property
as provided for by the Palesky Initiative would devastate the Cit)/s ability ro
provide essential services;
Whereas, the Palesky Initiative would exempt from the 1% cap the payment of interest
and principal on indebtedness approved by the voters prior to the effective
date of the initiative; and
Whereas, approval of all existing indebtedness of the City of Bangor will mitigate the
impact of the Palesky Initiative on the City of Bangor in the event that it is
enacted;
NOW, THEREFORE, BE IT ORDERED BY THE Cttt COUNCIL OF THE CITY OF BANGOR
THAT:
The Bangor City Council shall submit the following to be voted on at the November 2,
2004, municipal election:
"Shall the following Order be adopted?
The voters of the City of Bangor hereby ratify the prior actions of the
Bangor City Council in Incurring all currently existing Indebtedness of the
qty of Bangor."

hearing on August 23, 2004. Also attached is an opinion by City Solicitor Herrmann, an

ballot question contains any prohibition by the Bangor City Chanel, the general laws, the
United States Constitution or the Constitution of Maine.
