PRIOR TO MOVING THIS ORDER, A PUBLIC HEARING SHOULD BE HELD.
Once Ne heaving has been concluded, the Council can consider how it wishes to proceed.
This Order wbl place the question of whether the new police headquarters should be entered on
Maine Avenue or Mein Street to the voters of the City of Bangor on the November 2, 2004, ballot,
as the result of a successful citizens' refermdum conducted in accordance with the Chapter 18
of the Code of the City of Bangor.

(MLE.) ORDER, Placing an Order Entitled "Authorizing Construction of a Police
Headquarters Building at 240 Main Street, Bangor Maine" on the November 2,
2004, Municipal Ballot
WHEREAS, the current Police Headquarters located on Court Street no longer meets
the needs of the department and its employees;
WHEREAS, We Bangor City Council passed CO 04155 to sduate a new police
headquarters at 107 Maine Avenue; and
WHEREAS, a group of Bangor citizens formed a Petitioners' Committee and secured
the signatures of at least 2,274 registered Bangor voters as required by
the Ci y s Inibatve/Referendum Ordinance for the purpose of sending the
question of whether to situate the new police headquarters on Main Street
or Maine Avenue to the voters;
NOW, THEREFORE, BE IT ORDERED THAT:
The attached order entitled "Authorizing Construction of a Police Headquarters Building
at 240 Main Street, Bangor Maine", be placed on the November 2, 2004, municipal
ballot.

I have reviewed the above reference! petition. It is my opinion that the proposed
Order contained in the petition does not contain any provision prohibited by the Bangor
City Charter, the general laws, the United States Constitution or the Cor titution of
Maine.

WHEREAS, the current Police Headquarters located on Court Street no longer meets
the needs of the department and its employees; and
WHEREAS, the -Qty recognizes the importance of lecadng major public facilities,
includingthe police building, in or near downtown; and
WHEREAS, locating the police department at 240 Main Street will ensure ease of
access to the police department for businesses and the public; and
WHEREAS, the Council directed staff to proceed to develop a new police bullding at
107 Maine Avenue by adopting Council Order 04155 on May 24, 2004;
NOW, THEREFORE, BE 1T ORDERED THAT
Council Order 04-155 - is hereby rescinded and City stag is hereby
authorized and directed to take the necessary steps to proceed with the
location and constructionofthe police headquarters building at 240 Main
Street.
