The City has received a request from Webber Energy W create Q leased parking spaces on Curve
Street The propased parking cannot be constructed in the current space rlghtVf way. The City previously
acquired and cleaned up several dilapidated buildings on the westerly side of Curve Street. The land is tat
narrow for any type of building development. However, it Is suitable for construc0ng parking spaces by
widening the existing street rightroPway.
Council Order 04160 dlrecMtl the City Engines- to rake necessary action as prescdbed by 23 M.R.S.A.
§3022 and report his findings to the Council for final action. Approval of the attached! Council Order will
accept the City Englnea4 report (copy attached) and finalbe the widening. This has been reviewed by the
Transportation and Infrastructure Committee, which recommends appmval.

PUBLIC NOTICE
PROPOSED WIDENING OF CURVE STREET
TO ALL INTERESTED PARTIES:
The City of Bangor is considering widening Curve Street. This action is being pursued in
response to a request to crew 40 leased parking spaces on Curve Street
Notice s hereby given that In pursuance of City Council Order No. 04-160 passed June
14, 2004 directing the City Engineer to begin the process of widening the Curve Street right-of-
way as in accordance with 23 M.R.S.A. 43022. The City Engineer will hold a public hearing on
June R, 2904 at 9:00 a.m. in the Engineering Conference Room, City Hall, 73 Harlow Street
Bangor, Maine to consider widening of said street and determine the damages or benefits, If
any, sustained by any party as a result of this action, apportion same, If any, according to law,
upon the lots or parcels of land damaged or benefited by such widening.
Notice is hereby given to all persons interested In the premises to appear at the time
and place of meeting, if they see just cause then and there to be heard upon the subject.

"A certain parcel of land situated in the City of Bangor, County of Penobscot,
State of Maine, bounded and described as follows: Located on the nodhwestedy
side of Curve Street, bounded on the southwest by land described in deed of
Evelyn Boulder to Cabrel Company dated August 17, 1993 and recorded in
Perwbsoot Registry of Deeds Volume 5406, page 286; bounded on the northwest
and northeast by land described in deed of Chittenden Trust Company d/b/a
Chittenden Bank to CCM Associates dated July 30, 1993, and bounded on the
southeast by Curve Street, meaning and intending to Include all land described in
deed of Hazel E. Thomas, Robert A. Thomas, Richard J. Thomas, Linda Susan
Wills, and David William Thomas m the City of Bangor dated July 17, 2001 and
recorded in Penobscot Registry of Deeds Volume 7797, page 148."
At the public hearing, the City Engineer explained the proposed widening and the
reasons therefore, that the proposed widening and planned construction of on -street
parking was In the public interest as defined by law, and the overall process for
widening a public right-of-way. The City Engineer also explained that all land induced
in the widening is currently owned by the City of Bangor and described the specific area
Involved.
The following persons appeared at the public heading:
Judith Gagne — 68 Curve Street
Jahn Knowlton —T2 Cum Street
Kimberly Page— 40 Market Street
Jackie Hewitt —Cabrel Company.
The City Engineer answered several gu iftions about the proposed use of the widening
and traffic circulation. Ms. Gagne, Mr. Knowlton, and Ms. Paige all indicated an interest
in improving the neighborhood. No one spoke in opposition to the widening, nor has
any other communication been received relative to the proposed widening.
The City Engineer recommends that the Curve Street nght-of-way be widened to include
the area described above as part of the accepted Public Way. It is further
recommended that no benefits be assessed nor any damages be paid as a result of said
widening.

CITY ENGINEER'S REPORT
WIDENING OF CURVE STREET
June 23, 2004
Pursuant to Council Order 04-160, passed lune 14, 2004, directing the City Engineer to begin
the process of widening the Curve Street right-of-way and in accordance with 23 M.R.S.A.
§3022, the City Engineer reports: That of his Intention to widen the Curve Street right-of-way,
the Oty Engineer gave written notice (copy attached) together with a copy of Council Order 04-
160 to the following:

Said notice was also posted on the public bulletin boartl at Qty Hall and on two utility poles on
Curve Street in the vicinity of the proposed widening.
In accordance with the notification given, the Oty Engineer Conducted a public hearing on June
22, 2004 at the time and place indicated and proceeded to widen a portion of the Curve Street
right-of-way, which includes the area described as tallows:
