Item/Subject Ordinance, Amending Chapter 265-3C, Residential Collection, and 265-5A, Penalties, of
the Code of Ordinances- Residential Solid Waste -Time of Placement of Waste at Curb
Responsible Department: City Manager/Cede Enforcement
We have recently received a number of complain about solid waste being placed at Me curb for
collector well in advance of Me sdmtluled collection day. When MIs occurs, the chances of material
spilling from the container or bag are increasetl and the aesthi of the community suffer. In reviewing
our cunern solid waste ordinance, Mere is currently no restriction on how far in advance waste may be
placed at the cut for collection. Under this proposed amendment, solid waste could not be placed at Me
cut prior to 5 p.m.. on the day prior to scheduled collection.
Under the existing penalty section of the solid waste code, violators could be subject to a fine of $50 for a
first violation, $100 for a second, $250 for a Mira $500 fora forth, and $1,000 for five Armors. The penalty
section also provides that the Qty may suspend collection from multifamily units for repeated violations.
