Responsible Department Legal As an element of an overall set of interim adjustments to taxicab rates, the Finance Committee has recommended that the City approve a $1.00 per trip surcharge to address me recent dramatic increase in the cost of gasoline. An ordinance amendment memorizing such a surcharge appears elsewhere on tonight's agenda. This order would actually approve the a rcharge. The surcharge would be permissive, i.e., at the discretion of time drivel, and shall be for the sale benefit of the person responsible for paying for fuel her the cab. 1t will be in effect until April 21, 2006, at which time it will expire. The City will protide each taxicab with a notice of the surcharge, and the notice must be prominently displayed. Finally, the surcharge will take effect ten days from the Council's approval ofthis order, Thistenday period recognizes time required waiting period before the ordinance authorizing the surcharge actually goes into effect and will allow sufficient time for the appropriate notices to be prepared and distributed. ORDER, Establishing a Tazii Surcharge WHEREAS, the devastation caused by Hurricane Katrina In the southeastern United States has caused the rapid and unanticipated rise in the cost of gasoline throughout Maine and the United States; and WHEREAS, such increase in the cost of gasoline has a significant impact on the viability of operating taxicabs because taxicab rates are regulated by municipal ordinance; and WHEREAS, taxicabs supply a vital service to the City of Bangor and may, in some cases, constitute the only means of transportation for certain citizens; and WHEREAS, Chapter 278 § 278-6(G)of the Cade of the City of Bangor authorizes the City Council to establish a surcharge where it determines that such surcharge is warranted by conditions beyond the control of taxicab drivers and companies that affect the cost of providing taxicab service; and WHEREAS, a surcharge is necessary to mitigate the impact of the cost of gasoline on taxicab operations and thereby ensure continued service, NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CM OF BANGOR, THAT: Section 1: Taxicab driers may levy a surcharge of $1.00 per trip in addition to the standard fare authorized by 4 278-6. The surcharge shall be for the sole benefit of the person responsible for paying for fuel for the taxicab. Section 2: This Order shall expire on April 21, 2006, unless renewed by the City Council. Section 3. The City Clerk shall provide each tamcab with a notice of the surcharge. Said notice must be prominently displayed within the taxicab and dearly visible to the passengers. Section 4. This Order shall take effect ten days from its passage by the Bangor City Council.
