New York Street from Park and Open Space District to Urban Residence -One DistdQ.
THAT the zoning boundary lines as established by the Zoning Map of the City of Bangor dated
October 28, 1991, as amended, be hereby further amended as follows:
By changing a parcels of land located at 93 New York Street CTax Map No. 3, Parcel No. 1A)
from Park and Open Space District to Urban Residence -One District. Said parcel containing
approximately .42 acres and being more particularly indicated on the map attached hereto and
made a part hereof.

MEMORANDUM

Council Ordinance 05-327
Please be advised that the Planning Board at its regularly scheduled
meeting on October 18, 2005 held a public hearing on the above zone change
request.
Mr. James Ring, City Engineer, represented the applicant, City of Bangor.
Mr. Ring indicated that this is a private residential property located at the end of
New York Street and is surrounded by the City of Bangor's Municipal Golf
Course. Several years ago, this parcel was rezoned to Park and Open Space
District by the City of Bangor in anticipation of it becoming a part of the Golf
Course property. Over the last 30 years It has been a grandfathered
nonconformity and the City has still not acquired the property. The owners
have asked the City to rezone it back to URD -1 in ober for it to be a conforming
use.
No one spoke either in favor or in opposition to the requested zone
change.
The Planning Staff indicated that the proposed zone change request is
inconsistent with the Comprehensive Plan. However, given the fact that the City
created this nonconformity and still has not acquired the property for the Golf
Course, Staff feels it was fair to rezone it back to URD -1 to make it a
conforming use for the current property owner. Staff recommended that the
Planning Board recommend approval of C.O. # 05-327 to the City Council.
After careful considera0on of the existing uses in the area, the Board
voted five in favor and none opposed to recommend to the City Council that the
zone change request contained in C.O. # 05-327 be approved.
