THAT the City Manager and Fre Chief are hereby authorized, on behalf of the City of
Bangor, to execute a Memorandum of Understanding- Mutual No Agreement between the City
of Bangor and the 101" Maine Air National Guard (MeANG). A copy of said document is
attached hereto.

Emlosed is a Memorandum of Understanding between the I01"Me ANG Fire
Depamnart and the City ofHangor. This agreement would ensure the benefits of mutual
aid in fire prevention and in the protection of life and property from fire. Mutual aid will
be provided only when mission romaremems; for eilher the 101° Me ANG Fire
Department and for the City of Bangor are rot impeded. As you know oro pan and
current working relationship wiM the 101° ANG bas been excellent.

MEMORANDUM OF UNDERSTANDING
Between the 101"Me ANG Fire Department and the City Of Bangor
PURPOSE: Toms ffiebmefimofmulualaidinfirepreventionaadintbe

GENERAL: a)Gvregmgwarepresentativeofthe101'MeA GFire DepaMtentby
a representative OfWe City OfBaugor, fire fighting equipment and persomel of the 1010
MOANG Fire DeparWeat will be dispatched to my point within the anafor which the
City of Bangor normally provides fire protection as designated by the representatives of
the City of Bangor.
b) On request to a representative ofthe City of Bangor by arepresentative
of the 1W Me ANG Fire Department fire fighting equipment and personnel ofthe City
ofBmgmw he dispatched to any Point within the fire fighting response jurisdiction of
the thin Me ANG Fire Department as desigomed by the representative of the 1W Me
ANG Fire Department. -

but the amount and type of equipment and the number ofpersomel to
be furnished shell be determined by ampre conative of the responding

(2) the responding mensuration shall report to the officer in charge of the
requesting organization at the location to which the equipment is
dispatched, and shall be subject m the orders ofthaz ofireial.
(3) A responding organization shall be released by the mquesting
elimination when the services of the responding orgamstion are no
Ruder required or when the responding orgmiation is tussled witltin
the area£or which it unusually provides fire protection.
(4) In the event an crash oft aacreR owned or opereted by the Coined
States or military aucmR of my foreign flim within the area for
which the City of Bangor normally provides the protection, the chief
of the 101°MeA G Fire Department or his or her representative may
assume full command on arivrd at the scene of the crash.
(5) The obligation of either party m provide personnel or equipment
hereunder is subject to the responding mgaalaations determination than

it has adequate personnel or equipment mosib ble at the time as

d) The City of Bangor may claim reimbursement for the direct
expenses and losses that are additional fire fighting incident
costs above the normal operating costs incurred while fighting
a fire under this agreemem as provided m 0 CFR Pmt 151,
(Remal mtemem for Costs of Firefighting on Federal property)
e) Each party waives all claims against every oder partyfor
compensation for my loss, damage, personal injury, or death
occurring as a croswquevce ofthe performance of Us
agreement. This provision does not waive any right of
reimbursement purrosnt m paragraph (d) above.
f) All equipment used by the City of Bangor in carrying out this
agreement will, at the time of action hereunder, be owned by it;
and ell personnel acting for the City of Bangor under this
agreement wRI, at the time of such action, he an employee or
volunteer member of the City of Bangor.
g) The G may claim rambmsameat for the direct expense

ancomplished by mutual consent of both parties and awritten,
nodficatiom at lead 30 days in advance of proposed changes.
