Currently, smoking is banned within 100 feet of the building, but this does not prohlblt smoke from drlPong into the building, does rpt eliminate the waste that is generated frem smoking, and Me distance is difficult to judge and to enforce. ORDER, Establishing No Smoldig Policy for Bangor Health and Welfare Department, 103 Texas Avenue WHEREAS, the Health and Welfare Department provides a number of health related services and programs from its office at 103 Teras Avenue; and WHEREAS, these services and programs, including Women, Infants and Children (WIC), Public Health Nursing (PHN), and General Assistance (GA) all promoting good health and healthy lifestyle practices; and WHEREAS, the current no smoking policy is difficult to enforce, permits second-hand smoke to enter the building and does not effectively deal with the waste From smoking; and WHEREAS, establishing the Health and Welfare offices and premises as a smoke free area promotes their overall mission of good health and well-being. Given this, I believe it is only appropriate that we establish and enforce a smoke-free campus. I don't believe this policy will cause a significant hardship on anyone. In fact, I believe the majority of people who work and seek services will be protected from unwanted secondhand smoke and will both appreciate and respect our stance. The facts are: • The vast majority of people who come to 103 Texas Ave for services, are on site less than 45 minutes • There is a BAT bus stop on the edge of the parking lo[ where smoking appears to be permitted The current 100 foot rule is difficult to enforce and does not effectively keep the smoke from drifting into our building through open windows Waste from smoking activity; i.e. matches, butts, cellophane, etc. Is a problem As the city building that houses Women, Infants and Children (WIC), Public Health Nursing (PHN)'and General Assistance (GA), all health related services, I feel compelled to establish a policy that promotes good health and does not tolerate unhealthy practices As the Committee may be aware, the City Health and Welfare Department is a tenant in the building, which is owned by the Bangor Nursing and Rehabilitation Center (BNRC). If the Government Operations Committee approves of moving forward with the proposed policy, I would plan to meet with the new BNRC Administrator (who is scheduled to begin his duties on July le) W review the Policy and any implications it may have for their operation. Once any Issues are resolved, the Policy would be forwarded to Council for consideration and approval. I would propose to delay enforcement for one month after passage by the Council to allow us to post notices for people who regularly come to our offices in order to alert them to the new policy. 05-253 City of Bangor, Maine Health & Welfare Department Smoking/No Smoking Policy 103 Texas Avenue 1.0 PURPOSE The purpose of this policy is to establish-ao smoking policy for the Health& Welfare Department, 103 Texas Avenue in compliance with 22 MRSA 51541 at seq as passed by the Maine State Legislature effective January 1, 1994. 2.0 DEFINITIONS 2.1 Smoking. Smoking includes carrying or having i s possession a lighted cigarette, cigar, pipe or other object giving off tobacco smoke. 2.2 Designated Smoking Area. Public place means any place not open to the sky into which the public is invited or allowed. 2'.4 Enclosed Area. Enclosed area means space between a floor and a ceiling that is demarcated an allsidesby floor to ceiling walls, windows, doors or passageways. Partitions, partial walls or office dividers that do not extend from the floor to the ceiling are not demarcations of enclosed areas. 3.0 SMOAE-FREE CAMPUS , Smoking is prohibited on the City of Bangor Health & Welfare Department premises, 103 Texas Avenue, including the parking lot, walkways, green space between the building and the parking lot and all interior spaces. 4.0 POSTING SIGNS 'No Smoking' signs shall be posted on the Health & Welfare Department premises. 5.0 ENFORCEMENT AND DISCIPLINARY ACPION All employees, visitors and users of the Health & Welfare Department facility, 103 Texas Avenue, are expected to consider and observe the rights and privileges of smokers and non-smokers as provided by this policy. Any employee who fails to comply with or observe the OS -253 provisions of this policy shall be subject to appropriate disciplinary action in accordance with the City's Personnel Rules and Regulations. Additionally, any person who violates state law concerning smoking in public buildings has committed a civil violation_ for which a fine not to exceed one Hundred Dollars ($100.00) may be imposed. 6.0 EFFECTIVE DATE The effective date of this Policy shall be September 1, 2005 Edward A.
