in Abbot Square Lot, Aller Lat, and Haynes Court Parking Lot.

ORDERED, THAT
Section 1 1
Parking Schedule X ishereby amended by adding the following condition to Abbot Square
(Upper) and After Lot (Lower):
Between the hours of 10.00 p.m. and 6.00 a.m. no person shall remain in the
Parking lot and persons parking therein shall promptly Park or remove their
vehicles without remaining in the parking lot for any time longer than necessary
to do so.
Section 2
Parking Schedule XVI is hereby amended by adding the following condition to Haynes Court
Parking Lot:
Between the hours of 10:00 p.m. and 6:00 a.m. no person shall remain in the parking IN
and persons parking therein shall promptly park or remove Noir vehicles without
remaining in the parking lot for any time longer than necessary to do so.
Section 3
The Department of Public Works is directed to post said lots with signs stating:
'No person shall be permitted In the parking IM between the hours of 10:00 p.m. and
6:00 a.m. except promptly to park or remove a vehiice"

Su: Council Order 05-205 - Parking in the Area of Club Gemini
An amended version of this Council Order is attached to this item in the agenda.
This amendment clad0es the standard to be applied to individuals in the
designated parking lots during the hours between 10 p.m. and 6 a.m. The
revised language is as follows:
no person shall remain in the parking lot and persons parking
therein shall promptly park or remove their vehicles without
remaining in the parking lot for any time longer than necessary to
do so.
This change has been made at the request of the Government Operations
Committee after its review of the original order. -
Recent Events
Since this order has been introduced, the owners of Club Gemini have
contacted the City and have met with myself, the City Solicitor, Sally
Bates, our downtown coordinator, and representatives of the Police
Department. They have also scheduled a meeting with a representative of
the Franklin Place condominiums. In our discussions, they have proposed
to take Me following steps to address the noise concerns that prompted
the introduction of this order:
• Hire an accounstical engineer to make recommendations on steps that
can be taken to maximize containing performance noise within the
structure, particularly bass sound.
• Replace the interior wooden rear wall of the building with a cement or
block wall to reduce exterior sound
• Construct an exterior wall to the rear of the building to create an
additional sound barrier and to form a protected area for patrons
waiting to enter the building and or smoking. This would require an
agreement with the City to allow them to lease a portion of the City's
existing lower Abbott parking lot
• Investigate creating a separate smoking area within the structure to
eliminate the need for patrons to gather for this purpose in the parking
area
The owners have indicated a willingness to work with the City and
cencemed neighbors to address Me noise problems that have been
reported.
As currently written, the proposed order would cover lower and upper
Abbott Square and the Haynes Court parking areas. Given the limited
amount of space under the club's ownership outside of the building
envelop, these limitations are likely to have a significant impact on the
ability of the Club to operate. For example, there are times during busy
periods when patrons must queque outside of the building until other
patrons leave. This is done on City property in lower Abbott Square.
At this point and given the willingess of the owners to work toward
resolving the problem, the Council has a number of ahemalives:
1. Adopt the order as proposed
2. Amend the order to cover only upper Abbott as an intermediate step,
pending implementation of the other noise abatement possibilities
identified by the owners of the property
3. Refer the item back to Government Operations for additional
discussions between the City, the owners, and interested neighbors.
Staff will be prepared to discuss the situation with you on Monday. I
anticipate that Club Gemini's owners will also be present to outline their
concerns and plans. Should you have any questions, please feel free to
