In 1912, the federal government took the property on which City Hall now stands by eminent domain from
the Unitarian Universalist Society of Bangor, 120 Park Street. Over time, an ambiguity in the property line
with the Society has become apparent, either because the line was not clearly specified or because some of
the reference monuments have been removed, with the result being that the precise location of the line is
unknown. The purpose of this order is he of rm slively establish the property line between 120 Park Street and
Bangor City Hall at approximately eight feet from the existing exalting wall by exchanging quitclaim deeds.
The Finmhee Committee recommended that the Council approve this Order at its March 21, 2005, meeting.

Recommend approval. This question arose in regard to the ownership of the sidewalk on the Church side
of the retaining wall. Under this agreement, the sidewalk will be clearly located on Oty property.

Deborah A. Cyr, France Director, is hereby authorized to execute a quitclaim deed to one
Unitarian Universalist Society of Bangor, and accept a quitclaim deed from said Society, to
affirmatively establish the property line between 120 Park Street and Bangor City Hall at
approximately eight (8) feet horn the edge of the existing retaining wall. The final form of both
deeds shall be approvetl by the City Solicitor or Assistant City Solicitor.

In 1912, the federal government took the property on which City Hall
now stands by eminent domain from the Unitarian Universalist Society of
Bangor, 120 Park Street Over time, an ambiguity in the property line
with the Society has become apparent, either because the line was not
clearly specified or because some of the reference monuments have been
removed, with the result being that the precise location of the line is
unknown. - .
As you may know, there is a paved path that runs along this property
line connecting Park Street and Center Street. Over the past couple of
winters, this path has been closed because the path is too narrow to
properly plow and the Society has concerns about its potential liability J
a person were injured and the path, or a portion thereof, was found to be
on its property. While'the City is protected from claims by the Maine
Trp <etaims Act, the Society has no such protection.
Therefore, the Society has requested that the City and Society exchange
quitclaim deeds to affuxnatively establish the property line at eight feet
from the edge of the. retaining wall. This would ensure that the City
could maintain and repair the retaining wall as well as maintain and
possibly widen the path. This would also alleviate the Society's liability
concerns over the path.
Staff recommends that this Committee recommend approval of
exchanging quitclaim deeds with the Unitarian Universalist Society of
Bangor. to affirmatively establish the property line at approximately eight
feet from the retaining wall.
