"Community Advisory Group" for the Proposed Methadone Treatment Program of Colonial Management to be Ionated in the Maine Square Mall. Responsible Department: City Manager This Order Wit establish a Special Committee to serve as an advisory Group to the Colonial Management Methadone program planned for Me Maine Square Mall. It has been modeled after a similar group established to mr<with Acadia Hospital at the time that program began. The intent of this committee is M provide a forum for public comment and participation in the process of establishing this clinic and to insure that a communication mechanism Is in place W address any issues that may negatively impact the Immediate area of He program or the community at large. The Committee will include representatives of the City, Colonial Management, businesses in the area, and the State Department of Health and Human Services. Based on Me most recent available Information, Colonial continues m plan for opening Meir clinic in March. When this proposal was originally discussed by Me Government Operations Committee, the Committee felt that it was not yet timely. Given Me proposed opening date, members of the Committee requested Mat it be brought back for further discussion at the Committee's last meeting. At Mat time, Me Committee voted to recommend this order W Me full Council. A copy of Mis proposal has been provided to Colonial Management for Meir information and review. Order, Establishing a Special Committee of the City Council entitled "Community Advisory Group"for the Proposed Methadone Treatment Program of Colonial Management to be Located In the Maine Square Mail. WHEREAS, Colonial Management has proposed establishing a methadone treatment clink at the Maine Square Mall; and WHEREAS, concerns have been expressetl by other businesses located in and near this Mall as well as by other members of the community regarding the Impact that tit's clink may have on the Mall and on the community as a whole; and WHEREAS, the Maine Department of Human Services, Office of Substmrce Abuse, has issuetl two studies raising searching questions about clinical treatment of opioid addiction iso Maine; and WHEREAS, Chapter 42, Code of Federal Regulations, Part 8.12 provides that Opioid Treatment Programw, organizational structure, and frdlitles shall meet the requirements of all pertinent Federal, Stabs, ami local laws am regulations; and WHEREAS, the creation of a Community Advisory Group will ensure open Imes of cornmuniation between the City and Colonial Management and will provide a means by which the City, the State of Maine, and Colonial Management on evaluate Me Implications of the opening of another methadone clink in Bangor both in terms of the site chosen and for the community at large; and WHEREAS, Me creation of a Community Advisory Group on garter will ensure open lines of communication between the Cry and Colonial Managment, particularly in regard to gathering the necessary, Information to guage community Impacts and In on Identifying steps which on be taken to minimize any negative impacts which might be associated with such a program the proposed clinic NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR, THAT: In accordance with the Code of Me City of Bangor, Chapter 9, Section 9-9, a Community Advisory Group W the Methadone Clinic proposed by Colonial Management is hereby established as a Special Committee of the City Council. PURPOSE. Specifically, the (roup shall; • Obtain Information from Colonial Management on how it Intends to operate the proposed dinic ant what measures it Intends to employ M minimize any risk the proposed dinic may pose to the safety and security of others working at or patroniang the Maine Square Mall and the vicinity thereof as well as the community at large; • Advise Colonial management on program operation, particularly as it relates to potential community impact, law enforcement ant how the program is structural to recognize client oanfidenbality and privacy while Insuring Mat infomusJon Important to the community, police, and policy makers is made available in a lamely, and appropriate, and complete fashion; • Identify and communicate to program staff any problems in either the immediate area of the trenment program proposed clinic and, once in operation, tithe operating clinic or in the community as a whole which may be associated with the program clink and its services and developing recommendaRars on how these problems might be eifeclavely addressed; • Wok with the State Deparonent of Human Services, Office of Substance Abuse, and Me State Ucensirg Officer, any other area Oploid Treatment Program, anal the staff of Colonial Management, • Work with the State Department of Human Seracet Office of Substance Abuse, and Me State Ucamirg Officer, any other area Opioid Treabnent Program, and the staff of Colonial Management, inducting program stall, to consider the erten to which Opioid Treatrnent Programs should be required to adhere to "best practices" as raised in Technical Review Report of the Office of Substance Abuse, Phases I and 11; • Identify and specify tlrose measures which Colonial Management is willing to agree to as conditions of opening and operating the proposed dinic, ensure that those conditions are reduce0 W wining and agreed to; ant to Mmonitor program compliance with the various those assurances which have been made during the developmental stage of the program. COMPOSITION. The Communal Advisory croup shall be initially cernposed of the following: • Two representatives of the City of Bangor designated by the Coundl Chair and who are residents of the City of Banger; • Two representatives of Colonial Management designated by Colonial Management • One representative of the Bangor Police Department designated! by the Chief of Police; • A representative of the Stole Office of Substance Abuse or the Department of Health and Human Services Licensing Bureau desgnated by the Department of Health and Human Services; • Two representatives of the businesses located in close proximity to the methadone treatment program, to be selected by the Bangor City Cxmdl Chair. In addition, the Advisory Group may, with the concurrence athe representatives appointed by the Bangor City Council Chair and Colonial Management designate either individuals to become members of the Advisory Group as the Group may feel necessary or appropriate. While recognWng that the best Informed and most experienmtl individuals should serve on this Gaup, where possible and appropriate the representatives appointed by the Bangor City Council Chair shall give preference to residents of the City of Bangor when appointments to the Community Advisory Board are considered. TERM OF APPOINTMENT. Appointments M the Group shall be made for one year terms which may be renewed at the option of the appointing authority. 05-81 REPORTING RELATIONSHIPS. The Advisory Group shall make regular reports, in the form of minutes of meetings or other communications approved by the Group, to the the local program director of Colonial Managemen4 the Bangor Qty Council or a designated Council Committee, the Director of the State Office of Substance Abuse, and the Commissioner of the Department of Health and Human Services. MEETINGS. During Me Initial phase of program implementation, this group shall meet monthly or more frequently as needed. At the disorebon of the Goup, meetings may subsequently be held on a less frequent basis. Meetings shall be open to the public with prior public notice In accordance vAth the Freedom of Aooess law of the State of Maine. STAFF SUPPORT. Staff support for this Group shall be provided by the Ory of Bangor and Colonial Management, as designated by the City Manager and Coloniar s local program director. TERM OF EXISTENCE. The Community Advisory Group shall remain in eldstence for an initial term of three years, ending January 1, 2008. At that time, the Group shall determine whether a need remains for Rs continued existence and shall make a recommendation as to its continued existence to Colonial Management and the Bangor CM Council. EFFECTIVE DATE. This Order shall became effective upon its adoption by the Qty Council and its acceptance by Colonial Management.
