Commentary: With the 2004 opening of Pancce Municipal Aquatic Center, staff was asked to evaluate
the feasibility of continuing to operate Dakin Pool, Including obtaining an assessment of the condition of
the bath house. The City's general liability insurance loss control consultant Inspected the bath house
facilities and noted a number of deficiencies. An outside estimate from a consulting engineering firm
projects replacement at a cost in the range of $300,000. Given this cost, a sizeable decrease in
attendance hom 53 swimmers per day in 2002 W 15.5 swimmers Per day in 201 and increased
difficulty In allracOng qualified staff and lifeguards m work at this Pool, Me Parle: and Recreation
Department recommends that Dakin Pool not he re -opened.
This Order would direct the City Manager M take Me necessary steps to permanently close the Poor prior
to the beginning of the spring 2005 swim season. Parcae Pool Is capable of handling the number of
swimmers who had frequented Dakin Pool and this action would consolidate swimming acbmties at one
location.
This issue was reviewed at the January 11° Government Operations Committee meeting and was
recommended to the Council for passage.

A group has formed to oppose closing Dakin Pool. The Council may wish to consider deferring this item
back to the Government Operations Committee m allow for Me Committee and that group to further
discuss and explore this issue. Sufficient time is available prior to the need to either take actions to ready

WHEREAS, in 2004, the City opened the Pancoe Municipal Aquatic Center in Hayford
Park, providing significant improvement in outdoor swimming
opportunities and aavides; and
WHEREAS, with the opening of the Pancoe Pool, the City Council requested that Parks
and Recreation staff evaluate the feasibility of continuing to operate Dakin
Pool; and
WHEREAS, upon review, R has been determined that the Pool's bath house must be
replaced at an estimated cost of approximately $300,000 in order to be
compliant with various safety, Americans with Disabilities Act (ADA), and
code requirements; and
WHEREAS, attendance at Dakin Pool has dedined from an average of 53 swimmers
per day in 2002 to 15.5 swimmers per day In 2004; and
WHEREAS, it has become more difficult to attract qualified staff and lifeguards to
operate the pool, given the increased staffing needs at Pancoe Pool and
the Interest of employees to work A Pancoe Pool; and
WHEREAS, given these cont, attendance, and staffing issues, it does not appear to be
feasible to continue operation of Dakin Pool for the 2005 spring/summer
swim season and beyond.
NOW, THEREFORE, BE IT ORDERED BY THE BANGOR CITY COUNCIL, THAT: the City
Manager is hereby directed to take necessary steps M permanently close and secure
Dakin Pool prior to the 2005 swim season.

Staff has been concerned for quite some time about the
condition and safety of the bath house at Dakin Pool. Last May,
Maine Municipal Association Senior Loss Control Consultant
Ann Schneider confirmed our suspicions during her inspection.
She noted (see attachment) several structural deficiencies and
recommended that the building be repaired or replaced.
Recently, Carpenter Associates inspected the structure and
as you can see from their attached report they feel it is not
economically feasible to renovate the building. They also found
that the pool equipment is located in a confined space and
should be relocated to the ground level. It is Carpenter
Associates' recommendation that if the swimming pool continues
to operate, the existing bath house be demolished and a now
1300 square foot masonry building that meets current safety and
handicap standards be constructed at an estimated cost of
$3033000. It is also their assumption that renovation costs of the
existing structure would be close to the same amount and we
would not have the useful life of a new structure.

Recent attendance history at Dakin Pool has shown a
steady decline. The average daily attendance in 2002 was 53, in
2003 it was 35 per day and last summer it averaged 15.5 per day
while the new Pancoe Pool averaged 416 per day.
It is difficult for staff to recommend a $300,000 expenditure
while attendance continues to decline at Dakin Pool. Pancoe
Pool has certainly taken over as the main attraction for local
swimmers in the community. Last summer nearly $50,000 in
revenue was generated at Pancoe Pool
One future opinion the Council may want to consider is
replacing Dakin Pool with a Splash Pad in Broadway Park at an
approximate cost of $1257000. Splash Pads have become quite
popular in many parts of the country. The beauty of splash pads
is that they aro fully automated and require no supervision.
I will be present at your January 11'" meeting to discuss
this issue in greater detail.

Recommendation:
There is a pit below the secdon of pool building that houses
the send filtraticn system. There are plywood sections
(weak in spots) over the pit. The room is accessed by pool
and maintenance staff. The maintenance such go in the pit
for asneeded repairs. It is. not designated as a confined
space. There is limited imjresslegress,. no Iigining, and the
pit to 14 feet deep
Please evaluate this space and determine ff it is pennd or -
non-permit required coMned space. Ensure that staff have,
adequate training toenterthe pit, conduct gas sampling
prior to entry, and have rescue capabilities. -

3. Dakin Pool Bath House Renovation- For some time, staff has been concerned about
the whor n and safety M the belt house at Dakin Pool. During last years budget
access, Council requested that staff develop an admittetl fast to replace the structure
so that discussion could occur regarding the future operation of Dean Pool. Council
expressed interest in reviewing this issue prior to the FY05 budget process and the
normal late spring opening of the Mainly. A memorandum from Parks and Recreation
Director Comeau, along with an evaluation of the current building from Cilys General
Liability loss central consultant and an estimate from Carpenter Associates to replace
the structure was provided.

been sited In the past and the recommendation was made to either rap it or replace It.
Carpenter Associates recently inspected the structure and (a" report) have determined
it not economically feasible to renovate the building. They noted the pool equipment is

410 per day. It is difficult for the staff to propose the expenditure of $300K as Me
attendance is declining at Dakin Pool. Pancoe Pool has taken over as Me main
attraction of our swimming community, with over $501K in revenue last summer. One
future option the council may want to consider is to replace the Dakin Pool with a
splashaad in Broadway Park at an approximate cost of $100125k. Splashpads have

opening pools; stalling issues need to be considered as there are a limited number of
aerated lifeguards who are In high demand in this area. The council asked what the
lifespan of a splashpad is and what it might require for startup and supervision. It sues
noted that it does not require aupervuson for splashpatle and the life expectancy is 1015
years; equipment can be replaced; the water Is on a timer so it is not running 24 hors
per tlay - the timer is set, typically 10 a.m.- 6 p.m. Broadway Park Is not operated as a
supervised pork - the park tloes have a lot of usage and a splashpad would be an
attraction. There is no depth to a splashpad-Me water would provide heat relief arrd
add beauty to the area. This is an option to be at the Broadway Park location as a
replacement for Dakin Pool. Is there a liability concern? It would be similar to an
unsupervised playground. Does the bus route that would normally go to Dakin Pool go
by Broadway Park to enable the sammem who went to Dakin Pool to go to Broadway
Park to use Me splashiped? Yes, it is on a bus route.

It was noted that Pancoe exceeded he operating budget by $5k primarily because it
operated more hours than anticipated and we had a larger crowtl and needed more
guards an duty. The operating budget is close to S80k—last year's revenues were close
to $50k.
It was recommended, armed, seconded and voted t0 recommend to the Council Chet
Dakin Pool be closatl.
Addhonally, it was noted that demolition of the old Union Street Pod and bath house Is
estimated to be a winter project and cosh will be minial by utilizing City staff.
Re greet to Amend Mileage Reimbursement Rate for City Employees -At the last
erring, a recommendation was made to increase the current mileage reimbursement
re tont 33.5 canWmlleto40.5 cems/mile for employees using their personal vehicles
for business. The Committee requested additional information, which is was

move to 40.5 cents antl to incorporate the nguage that would allow the IRS to adjust
that rate, or comprumise betwreen current ra and 40.5. There was discussion of how
to rate comperes with Me country. The impac changing the rete to 40.5 cams would
be $5-61K it was moved and voted to increase to 0.5 cents per mile reimbursement
and to recommend that the Council change the Ci Wet Rules and Regulations
to adopt the IRS standard for mileage reimbursement.
