Commentary:
The City of Ballor has been in settlement discussion for some time in regards to the seven count violation
of the Resource Cor0ervation Recovery Act receivetl as a result of the EPA's August 2001 site inspection. The
attached resolve represents the estimated monetary settlement that will be required, In addition, the City
will undertake a supplemental environmental project that will likely involve the transition to the use of
biodiesel fuel in the City's fleet. This fuel produces a significant reduction in emissions from diesel vehicles.

City for violadoris of are Resource Coraervadon Act (KRA) is hereby appropriated as follows:
$25,477 from the Airport Reserves, $14,276 in FEMA funds received by the Motor Pool
Department and $16,497 of FEMA funds received by the Public Worlm Department. The Finance
Director is hereby authorized and direcbsd m pay the penalty when R becomes due and payable.
