_ Commentary:
This order will authorize staff to apply for FAA and MDOT grants for capital projects at
theairport under the Federal Airport Improvement program. Tbese grants will support the
relocation of an airport beacon, a new airport access control system and CCTV security
system, and a perimeter security system. Federal funds will cover 90% of the project, with
an additional 5% from the State. The local share is 5%. 1 would recommend your
approval.

WHEREAS, The City wishes to apply for the Airport Improvement Project grant funds
available through the Federal Aviation Administration and the Maine
Department Of Transportation to make Improvements to the infrastructure at
the Bangor International Airport and
WHEREAS, Federal funds will cover 90% of the Cost of the project with an additional
5% coming from Bre Slate of Maine and 5% from Bre City,
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF BANGOR
THAT
The City Manager and/or Airport Director be authorized to apply to the United States
Government Federal Admimstation`and the Slate of Maine, Department of
Transportation for relocating airport rotating beacon, installing new airport access

The Offer is made on and subject to the following terse and conditions:
1. The maximum obligation of the gaited States payable under this offer shall be
$529,146.00. For the purposes of eery future grant amendments which may increase the

foregoing mobligation of the United States under the provisions of Section 47108(b)
Of the Title 49 U.S.C., the following announce are being specified for this purpose.

2. The allowable costa of the project shall not include any costs determined by the Pion
to be ineligible for consideration as to allowability under Title 49 U.S.0
3. Payment of the United States share of the allowable project coats will be made
pursuant t0 and in accordance with the provisions of such regulations and procedures as the
Secretary shall prescribe. Final determination Of the United States share will be based
upon the final audit of the total amount of allowable project costa and eettlemmt will b,
made for any upward or downward adjustments to the Federal Share of Costs.
4. The Sponsor shall carry out and complete the Project without undue delays and i
ointone with the termshereof, and such regulations and procedures as the Secretary shall
prescribe, and agrees t0 COrply with the assurances which were aide part Of the project
application.
5. The PAA reserves the right to amend or withdraw this offer at any time prior to its
acceptance by the sponsor.
6. Thia offer shall expire and the United States shall not be obligated to pay any part
of the costs of the project unless this Offer has been accepted by the sponsor on or before
July 2, 2004, or such subsequent date as may be prescribed in writing by the FAA

For the purposes

share shall be approved in advance by the Secretary.
8. The United States shall not be responsible or liable for damage to property or injury to persons which may arise fram, or be incident t0, compliance with this grant agreement.
9. Buy American Requirement: Micas otherwise approved by the FAA, the sponsor will not
acquire or persit any contractor or subcontractor to acquire any steel or manufactured
products produced outside the United States to be used for any project for airport
development or noise compatibility for which funds are provided under this grout. The
Sponsor will include in every contract a provision iwplementing this special condition.
10. It isunderstood and agreed that n raimba[9emevta for engineering work will be made
until the independent coat estimates are teachers and the final contract is reviewed and
approved by the Federal Aviation Adulnistration.
11. The sponsor must provide for the continuous operation and maintenance of any
navigational aid funded under the AIP during the useful life of the egaipmenU and check the
facility prior to its comissioning to macre it meets the operational standards.
_The Sponsor's acceptance of this Offer and ratification and adoption of the Project
Application incorporated herein shall be evidemed by erecution Of this instrument by the
Sponsor, as hereinafter provided, and this Offer seal Acceptance shall comprise a Grant
Agreement, as provided by Title 49 U.S.C., constituting the contractual obligations and
rights of the United States and the Sponsor with respect to the a caaplishment of the
Project and compliance with the assurances
and conditions as provided herein. Such Grant
Agreement shall be effective upon the Sponsor's acceptance of this Offer.

NEW AIRPORT ROTATING BEACON (DesMn and ComMuclion)
--General Proud Description
The existing Almost Rotating Beacon Is currently located ontop ofihe City M Bangoes wstertaser. The access
to Ost beacon does nor meet currerd CGM standards and is considered unsafe W climb for required
maintenance on the beacon. This; project w$I Include the purchase and installation of a new beacon that meals
FAA criteria for an airport wilh a high Intensity mmwsy lighting system, a new High -Mast pine, foundation,
security fencing, and the comwctlon of sending u010ies to the rise, site. (See proposed site plan enclosed in
Appendix 1)

General PnAect Description
The existing airport access control system at Me Bangor International ArTort is extremely ord and ouddatetl. The
menufatlurer of Me system no longer carries parts for this system malting it suer so difficult to keep the system
running up to Me current FAA and TSA security requirements. The proposed project will Install a new access
control system that Nil¢as proximity cards, keypad access, and biometrics for methods aaccess. See
appendix 2 for a complete breakdown of all items included for the access control system.
The new CCN Security System will inWude the installation of a complete new system including CCN cameras,
e digital recording system, all all conduit and calla required far the installation of the system..

Relocation and Real Property,Acqudition.(1) It will be guided in partaking real
property. to the greatest extent prealicable under State law, by the land acquisition polities
in Subpart B of 49 CFR Pad 24 and will pay or reimburse property owners for necessary
expensesesspecifiedin Subparl (2)It will provide a relocation assistance program
offering the services described in Subpart C and fair and reasonable relocation payments
and assistance to displaced persons as regairetl in Supped 0 and E of 49 CFR Pan 24.
-(3) It will make available within a reasonable period of time prior to displacement
comparable replacement dwellings to displaced persons in accordance with Subpart E of
49 CFR Raft 24.

airport, however, it has no obligation to fund special facilities far intercity buses orfor other
modes of transportation.

Disadvantaged Business Enterprises. no recipient shall not discriminate on the basis.

contract or in the administration of Us DBE program or the requirements of 49 CFR Pal
26. The Recipient shall take all necessary and reasonable steps under 49 CFR Raft 26 to
ensure nen discrimination in the award and administration of OOTassisted contracts. The
recipient's DBE program, as required by 49 CFR Part 26, and as approved by DOT, is
incorporated by reference in this agreement. Implementation of this program is a legal
